2. The applicant requests correction of item 8a (Last Duty Assignment and Major Command) on his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Defense Intelligence Agency, Washington, D.C.; correction of item 12h (Effective Date of Pay Grade) to show 19 August 1988; and correction of item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) to show award of the Joint Meritorious Unit Award, the Joint Service Achievement Medal, and the Global War on Terrorism Service Medal.
3. The applicant did not provide an explanation. In support of his application, he submits a copy of his DD Form 214; deployment orders, dated 16 November 2001; orders for the Joint Service Achievement Medal; a citation for award of the Joint Meritorious Unit Award; and promotion orders, dated 19 August 1988.
4. Having prior active and inactive service, the applicant enlisted in the U.S. Army Reserve (USAR) on 17 April 1987 and was assigned to the 3415th Military Intelligence Detachment, Fort Sheridan, Illinois. He was ordered to active duty on 10 November 2001 in support of Operation Noble Eagle and was assigned to the Defense Intelligence Agency, Fort Sheridan, Illinois. He served as an intelligence analyst and was honorably released from active duty on 31 May 2002.
5. Item 8a on the applicant's DD Form 214 shows the entry, "3415 USA MI DET FC" [Military Intelligence Detachment Forces Command]. Item 12h shows the entry, "2001 08 27." Item 13 shows the Air Force Achievement Medal, the Air Force Outstanding Unit Award, the National Defense Service Medal, the Army Service Ribbon, the Armed Forces Reserve Medal with Mobilization Device, the Air Force Longevity Service Award Ribbon, the Air Force Overseas Service Ribbon (Long Tour), the Air Force Overseas Service Ribbon (Short Tour), the Air Force Training Ribbon, the Air Force Good Conduct Medal, the Expert Marksmanship Qualification Badge with Rifle Bar, the Expert Marksmanship Qualification Badge with Pistol Bar, and the Parachutist Badge as authorized awards.
6. There is no evidence of record which shows the applicant was assigned to the Defense Intelligence Agency in Washington, D.C.
7. 77th Military Intelligence Company Orders #12-01, dated 19 August 1988, show the applicant was promoted to specialist four on 19 August 1988 with a date of rank of 19 August 1988.
8. The applicant provided a citation for award of the Joint Meritorious Unit Award to the Defense Intelligence Agency for the period April 1999 to April 2002 by the Secretary of Defense. The office of the Defense Intelligence Agency confirmed that the applicant's unit was an element of the Defense Intelligence Agency and that he was entitled to award of the Joint Meritorious Unit Award.
9. Defense Intelligence Agency, Military Personnel Awards Orders Number
337-2, dated 3 December 2002, show the applicant was awarded the Joint Service Achievement Medal for the period 10 November 2001 to 31 March 2002.
10. The Global War on Terrorism Service Medal was recently established on
12 March 2003. This medal will be awarded to members of the Armed Forces of the United States who serve or have served in military operations to combat terrorism on or after 11 September 2001 and before a terminal date to be determined by the Secretary of Defense. The issuance of this medal has not been authorized. Therefore, this portion of the applicant's request will not be discussed further in these Proceedings.
CONCLUSIONS:
1. The evidence of record does not support the applicant's contention that his last duty assignment and major command was the Defense Intelligence Agency in Washington, D.C. Evidence of record shows his last assignment was the Defense Intelligence Agency, Fort Sheridan, Illinois. Therefore, it would be appropriate to correct item 8a on the applicant's DD Form 214 to show this assignment.
2. The applicant's date of rank for specialist four is 19 August 1988. Therefore, item 12h on the applicant's DD Form 214 should be corrected to show this date.
3. Evidence of record shows the Secretary of Defense awarded the Joint Meritorious Unit Award to the Defense Intelligence Agency for the period April 1999 to April 2002. The office of the Defense Intelligence Agency confirmed that the applicant's unit was an element of the Defense Intelligence Agency during that time and was thereby entitled to award the Joint Meritorious Unit Award. Therefore, item 13 on his DD Form 214 should be corrected to show this award.
4. Following the applicant's discharge from active duty on 31 May 2002, he was awarded the Joint Service Achievement Medal for the period 10 November 2001 to 31 March 2002. Therefore, item 13 on his DD Form 214 should be corrected to show this award.
5. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records but only as recommended below.
RECOMMENDATION:
1. That all of the Department of the Army records related to this case be corrected:
a. by deleting the entry, "3415 USA MI DET FC" in item 8a on the applicant's DD Form 214;
b. by adding the entry, "Defense Intelligence Agency, Fort, Sheridian, IL" in item 8a;
c. by deleting the entry, "2001 08 27" in item 12h on the applicant's DD Form 214;
d. by adding the entry, "1988 08 19" in item 12h on his DD Form 214; and
e. by adding the entries, "Joint Meritorious Unit Award" and "Joint Service Achievement Medal" in item 13 on his DD Form 214.
2. That so much of the application as pertains to correction of item 8a to show Defense Intelligence Agency, Washington, D.C. be denied.
