APPLICANT REQUESTS: Award of the Purple Heart.
APPLICANT STATES: In effect, that his right thumb is deformed and that it happened while he was on active duty. He submits no evidence in support of his request.
EVIDENCE OF RECORD: The applicant's military records show:
He served on active duty between 24 February 1969 and 17 September 1971.
While on active duty the applicant served a tour of duty in Korea between July 1969 and August 1970, and a tour of duty in Germany between September 1971 and February 1972.
There is no indication the applicant was ever in a combat theater.
The applicant's separation physical examination does note that the applicant injured his right thumb while in Germany in May 1971.
Army Regulation 600-8-22 provides, in pertinent part, that the Purple Heart is awarded for wounds sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. There is no evidence, and the applicant has not provided any, that he was ever wounded as a result of hostile action. In the absence of such evidence, there is no basis for an award of the Purple Heart.
2. The fact that he may have suffered an injury while on active duty does not serve as a basis for an award of the Purple Heart.
3. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
4. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
