         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that the Kuwait Liberation Medal (Kuwait) be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty).

3. The applicant states that the medal was authorized for his participation in Operation Desert Storm during the period February 1991 through April 1991 and adds that the same qualifications apply to this award as for the Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia.

4. The applicant’s military records show that he entered active duty on 3 March 1987 and was discharged on 25 May 1988 for the purposes of accepting an appointment as a warrant office in the Army of the United States. The applicant was called to active duty as an Army Aviation Warrant Officer on 26 May 1988.

5. The applicant was ordered to proceed on temporary duty on 11 February 1991 in support of Operation Desert Storm while assigned to Headquarters and Headquarters Battery, Headquarters Command, US Army Field Artillery Center and Fort Sill, Oklahoma, for a period not to exceed 179 days.

6. The applicant was honorably released from active duty on 25 May 1993 at the expiration of his term of service in the rank and pay grade Chief Warrant Officer Two, W2. The DD Form 214 he was issued on his release from active duty shows, in Block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), that during his Army service, he was awarded: the Air Medal; the Army Commendation Medal; the Army Service Ribbon; the Good Conduct Medal; the Kuwait Liberation Medal; the National Defense Service Medal; the Meritorious Unit Commendation; the Southwest Asia Service Medal with 3 bronze service stars; and the Army Aviator Badge.

7. The applicant’s DD Form 214 shows that he was awarded the Kuwait Liberation Medal; however, it does not identify whether it was awarded by the Kingdom of Saudi Arabia or the Government of Kuwait.

8. The Kuwait Liberation Medal (Saudi Arabia), awarded by the Kingdom of Saudi Arabia (KLM-SA), was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991.

9. The Kuwait Liberation Medal, awarded by the Government of Kuwait (KLM-K), was approved on 9 November 1995 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993.


CONCLUSIONS:

1. Evidence of record shows that the applicant served in Southwest Asia during the qualifying period for which award of the Kuwait Liberation Medal (Saudi Arabia) and the Kuwait Liberation Medal (Kuwait) was authorized.

2. The Kuwait Liberation Medal is shown in Block 13 of the applicant's DD Form 214; however, it does not specifically identify whether the Kingdom of Saudi Arabia or the Government of Kuwait awarded it. It is believed that the Kuwait Liberation Medal shown was awarded by the Kingdom of Saudi Arabia since it was approved on 3 January 1992, before the applicant was released from active duty.

3. The applicant is entitled to award of both these medals and entitled to have his DD Form 214 corrected to reflect both the Kuwait Liberation Medal (Saudi Arabia) and the Kuwait Liberation Medal (Kuwait) among his awards and decorations.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all Department of the Army records related to this case be corrected by:

a.       deleting the Kuwait Liberation Medal from Item 13, DD Form 214; and

b. adding the Kuwait Liberation Medal (Saudi Arabia) and the Kuwait Liberation Medal (Kuwait) to the applicant's DD Form 214.
