         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his records to show that he was awarded the Army Commendation Medal.

3. The applicant states, in effect, that he was awarded the Army Commendation Medal, but it was never placed on his DD Form 214, separation document.

4. In support of his request, he submits copies of an award certificate, which reflects that he was awarded the Army Commendation Medal on 26 March 1991, for meritorious achievement during Operation Desert Storm. He also submits the first page of an award recommendation, for the Army Commendation Medal.

5. The applicant’s military records show that he entered active duty on 22 October 1986 and completed training as a general construction equipment operator. He served in Southwest Asia from 21 October 1990 through 13 April 1991. The applicant was honorably discharged on 25 March 1993.

6. The applicant's DD Form 214 does not show award of the Army Commendation Medal.

7. In July 1991, a Promotion Point Worksheet was completed on the applicant. It reflects that he was granted 20 points for one award of the Army Commendation Medal.

8. Orders reflect that the applicant was awarded the Air Assault Badge and the Army Good Conduct Medal, second award, for the period 22 October 1989 through 21 October 1992. These awards are not shown on his DD Form 214.

9. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that a clasp, bronze, 2 loops is authorized for wear on the Army Good Conduct Medal to denote a second or subsequent award.

10. The Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia (KLM-SA) was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991. It is this award, without the acronym, that is currently reflected on the applicant's DD Form 214.









11. The Kuwait Liberation Medal awarded by the Government of Kuwait (KLM-K) was approved on 9 November 1995 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993.

CONCLUSIONS:

1. Evidence of record establishes that the applicant was awarded the Army Commendation Medal, twice awarded the Army Good Conduct Medal, and the Air Assault Badge. He is entitled to correction of his records to reflect these awards.

2. Based on the applicant’s service in Southwest Asia in support of Operation Desert Storm, he should be awarded the Kuwait Liberation Medal (KLM-K) awarded by the Government of Kuwait.

3. The applicant's DD Form 214 currently reflects the Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia without the acronym KLM-SA.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by:

a. showing that the individual concerned was awarded the Army Commendation Medal, the Air Assault Badge, the Army Good Conduct Medal with bronze clasp with 2 loops;

b. deleting the Kuwait Liberation Medal in DD Form 214, block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized [All periods of service]); and











c. showing he was awarded the Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia (KLM-SA) and the Kuwait Liberation Medal (KLM-K) awarded by the Government of Kuwait.
