         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his report of separation (DD Form 214) be corrected to reflect his correct rank, military occupational specialty (MOS) and his award of the Army Achievement Medal (AAM).

3. The applicant states that his DD Form 214 dated 10 August 2002 should be corrected to reflect his correct rank of sergeant (SGT), his correct MOS of 92A20 and his award of the AAM. In support of his application he submits a copy of his promotion orders to the rank of SGT on 19 March 2002, in MOS 92A20, and a copy of his AAM orders dated 9 August 1994.

4. The applicant’s military records show that he initially enlisted in the United States Army Reserve (USAR) on 1 October 1991. He was awarded the MOS of 92A10 (Automated Logistics Specialist) on 28 July 1992.

5. On 9 August 1994, the applicant was awarded the AAM for meritorious service during the period of 1 October 1991 to 21 June 1994.

6. On 10 October 2001, while serving in the USAR in the pay grade of E-4, he was ordered to active duty in support of Operation Enduring Freedom.

7. On 19 March 2002, he was promoted to the rank of SGT (E-5), effective 19 March 2002, in MOS 92A20.

8. The applicant was honorably released from active duty (REFRAD) on 10 August 2002, due to completion of required service. At the time of his REFRAD, he was issued a DD Form 214, which shows he was REFRAD in the pay grade of E-4, in MOS 71L10 (administrative specialist). His award of the AAM was also omitted from his DD Form 214.

CONCLUSIONS:

1. The applicant was promoted to the pay grade of E-5 in MOS 92A20 while on active duty in support of Operation Enduring Freedom. However, an administrative error resulted in that data not being reflected on his DD Form 214 at the time of his REFRAD.

2. Additionally, the applicant was awarded the AAM in 1994 that should also have been included on his DD Form 214.

3. Accordingly, the Board finds that it would be in the interest of justice to correct those administrative errors at this time.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.
RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by showing that at the time of his REFRAD on 10 August 2002, the individual concerned was REFRAD in the pay grade of E-5, with a date of rank of 19 March 2002, in MOS 92A20, and that he was awarded the AAM.
