         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his service in Bosnia from March 1997 to October 1997 with Company A, 113th Armor Battalion.

3. The applicant states that his DD Form 214 does not reflect this service. In support of his application, he submitted a copy of his DD Form 214.

4. The applicant’s military records show that he enlisted into the Regular Army on 20 September 1995 for a period of three years. He completed the required training and was awarded military occupational specialty 19K (Armor Crewman). The applicant completed his term of service and was honorably released from active duty on 19 September 1998.

5. The applicant's DD Form 214 does not show he served in Bosnia. His separation document does not show any foreign service in item 12f (Foreign Service).

6. His DD Form 214 shows entitlement to the Armed Forces Service Medal and the North Atlantic Treaty Organization Medal in item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized).

7. Military Personnel Message number 96-068 announced that the Secretary of Defense approved the offer of the NATO Medal made by the NATO Secretary General for operations relating to the Republic of Yugoslavia.

8. Military Personnel Message number 96-098 established the Armed Forces Service Medal (AFSM) and award for operations relating to the former Republic of Yugoslavia.

9. Records from the Defense Finance and Accounting Service (DFAS) show the applicant received hostile fire pay during the period March 1997 through October 1997.

10. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. In pertinent part, it directs that foreign service performed during the period covered by the DD Form 214 will be entered in block 12f. This regulation also states that an active duty soldier ordered to active duty and deployed with his or her unit during their continuous period of active service will be reported in item 18 (Remarks) of the DD Form 214 with the statement: "SERVICE IN (Name of Country Deployed) FROM (inclusive dates)."




CONCLUSIONS:

1. The applicant's DD Form 214 does not currently show any foreign service in block 12. However, his DD Form 214 shows the Armed Forces Service Medal and the North Atlantic Treaty Organization Medal as authorized awards for service in the former Republic of Yugoslavia (to include Bosnia).

2. Records available to the Board show the applicant received hostile fire pay during the period March 1997 through October 1997.

3. Based on the evidence of record, the Board has determined that the applicant's DD Form 214 should be corrected to show the entry: "SERVICE IN BOSNIA: MARCH 1997 TO OCTOBER 1997."

4. The Board has also determined that block 12f on the applicant's DD Form 214 should be corrected to show he completed 7 months of foreign service.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected:

a. by amending block 18 on the applicant's DD Form 214 to show the entry: "SERVICE IN BOSNIA: MARCH 1997 TO OCTOBER 1997;" and

b. by amending block 12f on his DD Form 214 to show he completed 7 months of foreign service.
