THE BOARD ADDITIONALLY FINDS:

17. On 6 February 2003, an official of the Army Review Boards Support Division-St. Louis found a hospital admission record in the archived records maintained by the Office of The Surgeon General of the Army. This record shows that the applicant was admitted to a General Hospital in November 1944 as a battle casualty for wounds to the head and back from artillery shell fragments.

18. The Board also noted that the applicant's WD AGO Form 100 (Separation Qualification Record) states that he was wounded in Germany in November 1944.

THE BOARD ADDITIONALLY CONCLUDES:

9. At the time of the Board’s 26 February 2002 decision in Docket Number AR2001065045, it was the intent of that Board to make the applicant’s record as administratively correct as it should properly have been at the time of his discharge from the Army on 25 October 1945.

10. In view of the hospital admission records which show that the applicant was admitted in November 1944 to a General Hospital as a battle casualty with shell fragment wounds to the head and back , there is sufficient evidence to show the applicant is entitled to award of the Purple Heart for wounds sustained in November 1944 in Germany.

11. In view of the hospital admission records which show that the applicant was admitted in November 1944 to a General Hospital as a battle casualty with shell fragment wounds to the head and back, there is sufficient evidence to warrant correction of item 34 (Wounds Received In Action) of the applicant's WD AGO Form 53-55 (Enlisted Record and Report of Separation-Honorable Discharge) to show the entry, "SHELL FRAGMENT WOUND, GERMANY NOVEMBER 1944."

12. Based on the foregoing, this Board determined that there is sufficient evidence to overturn the previous decision of the Army Board for Correction of Military Records in Docket Number AR2001065045 on 26 February 2002 not to award the Purple Heart

13. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.

THE BOARD RECOMMENDS:

3. That all of the Department of the Army records related to this case be corrected by amending the Board’s recommendation appearing in the proceedings, dated 6 February 2002, to show:
         a. the individual concerned was awarded the Purple Heart for wounds sustained in action in November 1944;

         b. item 34 (Wounds Received In Action) of the53-WD AGO Form 53-55 (Enlisted Record and Report of Separation-Honorable Discharge) of the individual concerned was amended to show the entry, "SHELL FRAGMENT WOUND, GERMANY, NOVEMBER 1944."
