         I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show the Presidential Unit Citation unit award.

3. The applicant states that he served in Vietnam with Company A, 2nd Battalion, 506th Infantry, 101st Airborne Division from 1969 to 1970, as the 3rd Platoon field medic at the time the unit was awarded the Presidential Unit Citation. In support of his application the applicant submits a copy of the citation award signed by President Nixon and a copy of the "Lineage and Honors" for the 2nd Battalion,
506th Infantry.

4. The applicant’s military records show that he enlisted in the Regular Army for a period of 3 years. He completed the required training and was awarded military occupational specialty 91B20 (Medical Specialist).

5. The applicant's records show that he served in Vietnam from 28 April 1969 through 6 April 1970.

6. DA Form 20 (Enlisted Qualification Record) shows that the applicant was assigned to Headquarters and Headquarters Company, 2nd Battalion, 506th Infantry. Duty assignment shows that he was a company aidman.

7. There are no orders which show that the applicant was assigned to Company A. However, the applicant's records contain 101st Airborne Division General Orders Number 14296, dated 5 December 1969, which awarded the Air Medal to selected members of Company A, 2nd Battalion, 506th Infantry for the period
5 August through 6 November 1969. The applicant's name is listed on these orders but with a pencil entry next to his name showing "HHC."

8. The applicant was honorably released from active duty on 1 October 1971 after completion of 2 years, 11 months and 28 days of creditable active service with no lost time.

9. There is no indication in the applicant's personnel record that shows he was awarded the Army Good Conduct Medal. There is no evidence that the applicant was disqualified by his unit commander for the Army Good Conduct Medal. His record shows that he received excellent conduct and efficiency ratings during his entire period of service.

10. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) shows that Company A, 2nd Battalion, 506th Infantry was awarded the Presidential Unit Citation for the period 10 through 21 May 1969, based on Department of Army General Order Number 16, dated 1972.

11. Army Regulation 672-5-1 provides, in pertinent part, that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct,
efficiency and fidelity during a qualifying period of active duty enlisted service.
This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. At the time, a soldier's conduct and efficiency ratings must have been rated as excellent for the entire period of qualified service.

CONCLUSIONS
:

1. There are no orders which show that the applicant was assigned to A Company, 2nd Battalion, 506th Infantry.

2. The Board noted that the applicant's DA Form 20 showed he was assigned to Headquarters and Headquarters Company , 2nd Battalion, 506th Infantry with duties as a company aidman.

3. The Board also noted 101st Airborne Division General Orders 14296, dated
5 December 1969 showed he was in Company A, 2nd Battalion, 506th Infantry.
However, those orders contain a pencil entry next to his name showing "HHC." In addition, the orders were for award of the Air Medal for the period 5 August through 6 November 1969.

4. The Board presumes he was attached to Company A, 2nd Battalion, 506th Infantry for some period of time; however, there is no evidence to show he was assigned or attached to Company A in May 1969 when the Presidential Unit Citation was awarded.

5. The Board concludes the applicant met the regulatory requirements for the first award of the Good Conduct Medal for the period 4 October 1968 through
1 October 1971 based on completion of a period of qualifying service ending with the termination of a period of Federal military service. Therefore, the applicant is entitled to the award of the Good Conduct Medal and he is entitled to correction of his DD Form 214 to show the award.

6. In view of the foregoing, the applicant’s records should be corrected but only as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by:

a. awarding the applicant the Army Good Conduct Medal for the period
4 October 1968 through 1 October 1971; and
b. amending the applicant's DD Form 214 to show the award of the Army Good Conduct Medal.

2. That so much of the application in regard to award of the Presidential Unit Citation is denied.
