         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that her separation document be corrected to show that she served 6 years, 3 months and 7 days, not 6 years, 3 months and 6 days.  She also requests that she be awarded the Humanitarian Service Medal (HSM).

3. The applicant states that from 25 to 31 March is seven days.

4. In support of her request, she submits the documents which shows she was part of a task force which was approved for award of the HSM.

5. The applicant’s military records show that she was commissioned as a surgical nurse and entered on active duty on 25 July 1993. She was honorably released from active duty in the rank of captain on 30 October 1999. Item 12c of her separation document, Net Active Service This Period, has 6 years, 3 months and 6 days entered.

6. The Department of Defense Military Pay and Allowances Entitlements Manual (DODPM), paragraph 10108, states that to calculate creditable service for basic pay, you subtract the beginning date of service from the ending date, and add one day for inclusive service. The only exception is when the ending date is the last day of the month and is a date other than 30. The end date will be changed to 30 for calculating the soldier’s creditable service.

CONCLUSIONS:

1. The applicant has submitted documentation showing that she is entitled to the HSM. As such, she is entitled to have that award added to her separation document.

2. However, Item 12c, Net Active Service This Period, correctly shows that she served 6 years, 3 months and 6 days. This is calculated as follows:

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.





RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by adding to the separation document of the individual concerned the HSM.

2. That so much of the application as is in excess of the foregoing be denied.
