         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his records to show award of the Army Reserve Components Achievement Medal (ARCAM) with "one device" (correctly known as the ARCAM with one Oak Leaf Cluster).

3. The applicant states that he believed that the proper documentation had been submitted when he was separated from his former Army National Guard unit in 1993, but it had not been added to his records. In support of his application, he submitted a copy of his DD Form 214 (Certificate of Release or Discharge from Active Duty) and his NGB Form 22 (Report of Separation and Record of Service).

4. The applicant’s military records show that he enlisted in the Army National Guard on 26 April 1986 for a period of eight years. He was ordered to initial active duty for training (IADT) on 25 June 1986 for basic training under the split training program. Upon completion of training, he was transferred back to the Army National Guard. He was ordered to IADT on 17 June 1987 for advanced individual training at Fort Benning, Georgia. The applicant was released from active duty on 7 August 1987 and transferred back to the Army National Guard. The applicant was discharged from the Army National Guard on 5 April 1993 in the rank of specialist.

5. The applicant's military records do not show the ARCAM with one award of the Oak Leaf Cluster as an authorized award.

6. The applicant's personnel records contain a DA Form 268 (Report to Suspend Favorable Personnel Actions (Flag)), dated 11 April 1992. This document shows a flag was initiated against the applicant effective 8 March 1992 and was entered in the Weight Control Program.

7. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Army Reserve Components Achievement Medal is authorized for award to Army personnel including Active Guard Reserve officers in the rank of colonel and below for exemplary behavior, efficiency, and fidelity while serving as a member of an Army National Guard or Army Reserve troop program unit or as an individual mobilization augmentee. Since 3 March 1972 the medal has been authorized on completion of 4 years service with a Reserve Component unit. Individual must have completed 4 years of qualifying service on or after 3 March 1972 and before the effective date of this regulation (28 March 1995). Beginning on the effective date of this regulation (25 February 1995), the period of qualifying service for award of the Army Reserve Components Achievement Medal is reduced from 4 to 3 years. This change is not retroactive. Such years of qualifying service must have been consecutive. A period of more than 24 hours between Reserve enlistments or officer’s service will be considered a break in service. Credit toward earning the award must begin anew after a break in service.

CONCLUSIONS:

1. The evidence of record shows the applicant served in the Army National Guard during the period 26 April 1986 through 5 April 1993.

2. Records show the applicant completed four years of qualifying service in the Army National Guard from 26 April 1986 through 25 April 1990 for award of the ARCAM. Therefore, he is entitled to one award of the ARCAM.

3. There is no evidence of record which shows the applicant completed the four years of qualifying service for a second award of the ARCAM. Therefore, there is no basis for correcting his military records to show he was awarded the ARCAM with one Oak Leaf Cluster.

4. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records but only as recommended below.

RECOMMENDATION:

1. Insofar as records of the Washington Army National Guard are concerned, the ABCMR recommends that the Adjutant General of the State of Washington correct the records of the individual concerned to show he was awarded the ARCAM.

2. That so much of the application as it relates to the ARCAM with one Oak Leaf Cluster be denied.
