         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show award of the NATO Medal.

3. The applicant states that he is sending the certificate showing that he was awarded the NATO Medal for his service in Bosnia. The certificate is not included with the applicant's request.

4. The applicant’s military records show that he enlisted in the Army National Guard in 1998 and has served continuously with the Guard since then.

5. On 8 February 2001 the applicant was ordered to active duty for a period of 270 days effective on 15 February 2001, in support of Operation Joint Forge.
His DD Form 214 shows that he served in Germany from 24 February 2001 until his assignment to Bosnia on 11 March 2001.

6. In a 6 August 2001 memorandum to the Chief of Staff, Task Force Eagle, Multinational Division (North), Tuzla, Bosnia-Herzegovina, the applicant's commanding officer requested that the applicant be released from assignment with Task Force Eagle with a proposed departure date of 14 August 2001. That officer indicated that the applicant's tour had ended. He also stated that the applicant was authorized the NATO Medal, the Armed Forces Expeditionary Medal, and the Armed Forces National Guard Medal with "M" device.

7. Orders were published on 8 August 2001 reassigning the applicant to Fort Benning, Georgia. Those orders show that the applicant was authorized the NATO Medal and the Armed Forces Expeditionary Medal.

8. The applicant was released from active duty on 17 August 2001 and transferred to his National Guard unit in Draper, Utah. His DD Form 214 shows award of the Armed Forces Expeditionary Medal and the Armed Forces Reserve Medal with "M" device, but not the NATO Medal.

9. The NATO Medal is awarded by the Secretary General of NATO. The Secretary of Defense approved the offer of the NATO Medal for operations relating to the former Republic of Yugoslavia. The qualifying period of service is 30 days in the territory of the former Republic of Yugoslavia.

CONCLUSIONS:

1. The applicant is entitled to award of the NATO Medal. His DD Form 214 should be corrected accordingly.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the applicant was awarded the NATO Medal.
