         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) show his correct date of entry on active duty as an officer and the corresponding computations be corrected.

3. The applicant states that prior administrative corrections to his DD Form 214 still show an incorrect date, which should be 20 February 1988.

4. The applicant’s military records show that he had prior enlisted service when he was ordered to active duty as a second lieutenant for the officer basic course with a reporting date of 23 February 1988. His permanent duty station reporting date was 4 May 1988. His DD Form 214, dated 15 October 1997, shows that he was discharged as a Regular Army major on that date. His date of entry on active duty is shown as 7 March 1984 and his total active service for the period is shows as 13 years, 7 months, and 9 days.

5. A DD Form 215 (Correction to DD Form 214), issued on 21 August 2002, incorrectly shows his date of entry on active duty as 4 May 1988 with corresponding incorrect changes to his total active service for the period as 11 years, 5 months, and 12 days.

6. The applicant's Officer Record Brief (ORB) shows the entry of 21 February 1988 as the date of his entry on active duty for his current tour as an officer. There is no evidence of record that shows any different date of his entry on active duty.

CONCLUSIONS:

1. The applicant's DD Form 214, dated 15 October 1997, and his DD Form 215, issued on 21 August 2002, show his date of entry on active duty and his total active service for the period incorrectly. His ORB shows an entry on active duty date of 21 February 1988.

2. The applicant is entitled to correction of his DD Form 214, dated 15 October 1997, to show his date of entry on active duty for that period as 21 February 1988 and his total active service for the period as 9 years, 7 months, and 25 days.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case for the individual concerned be corrected:


         a. by correction of his DD Form 214, dated 15 October 1997, to show his date of entry on active duty for that period as 21 February 1988; and

         b. by correction of his DD Form 214, dated 15 October 1997, to show his total active service for the period as 9 years, 7 months, and 25 days.

2. That so much of the application as is in excess of the foregoing be denied.
