PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 13 March 2003
         DOCKET NUMBER: AR2002078457

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Ms. Beverly A. Young Analyst

The following members, a quorum, were present:

Mr. Thomas A. Pagan Chairperson
Mr. Roger W. Able Member
Mr. John A. Kelley Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests that the National Defense Service Medal be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty).

3. The applicant states that he was given the National Defense Service Medal while in basic training, along with the rest of his company, in 1992. He states that the medal does not appear on his DD Form 214. In support of his application, he submits a copy of his DD Form 214.

4. The applicant’s military records show that he enlisted in the U.S. Army Reserve on 25 June 1991 for a period of eight years. He was ordered to active duty for training on 15 June 1992. He successfully completed training as an intelligence analyst and was honorably released from active duty on 13 November 1992. The applicant was transferred back to his USAR unit and was discharged from the USAR on 29 June 1999.

5. The applicant's DD Form 214 does not show the National Defense Service Medal as an authorized award.

6. His DD Form 214 shows he was ordered to active duty for training on 15 June 1992 and was released from active duty on 13 November 1992.

7. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 through 27 July 1954, 1 January 1961 through 14 August 1974, 2 August 1990 through 30 November 1995 and 11 September 2001 to a date to be determined. However, paragraph 2-10b(1) of this regulation states that Army National Guard and U.S. Army Reserve forces personnel on short tours of duty to fulfill training obligations under an inactive duty training program will not be considered as performing active service which qualifies for award of the National Defense Service Medal.

8. Paragraph 2-10c of Army Regulation 600-8-22 states, in pertinent part, that the National Defense Service Medal is awarded for all members of the Army National Guard and United States Army Reserve who were part of the selected Reserve in good standing during the period 2 August 1990 to a date to be determined.

CONCLUSIONS:

1. Records show the applicant enlisted in the USAR on 25 June 1991 and was ordered to active duty for training from 15 June 1992 to 13 November 1992.

2. The applicant served a period of qualifying service for award of the National Defense Service Medal. Therefore, he is entitled to award of the National Defense Service Medal and correction of his DD Form 214 to show this award.
3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the National Defense Service Medal.
