         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his National Guard Bureau Form 22 (Report of Separation Record of Service in the Army National Guard of the United States and the Army National Guard of California) be corrected to show that his separation date was 15 February 1953 vice 15 February 1950. He submits his National Guard Bureau Form 22 in support of his request.

3. The applicant was a member of the Army National Guard and no additional records, beyond his National Guard Bureau Form 22, were available to the Board. That document, however, shows that the applicant enlisted in the Army National Guard on 16 February 1950 for a period of 3 years. Information contained in item 33 (reason and authority for discharge) on the form indicates the applicant's enlistment termination date was 15 February 1953. However, item 7 (date of discharge) shows that the applicant was separated on
15 February 1950.

CONCLUSIONS:

1. While the applicant's military personnel records were not available to the Board, clearly the evidence that is available does confirm that the applicant's separation date was 15 February 1953 and not 15 February 1950. The 1950 date in item 7 of his separation document was likely a typographical error.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That official at the National Guard Bureau be requested to correct the applicant's separation document to show that he was discharged from the Army National Guard on 15 February 1953 vice 15 February 1950.
