         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. In effect, the applicant requests award of the Combat Infantryman Badge (CIB).

3. The applicant states that he was an infantryman with Company B, 15th Infantry Regiment, and was wounded in action on 12 June 1953 on Outpost Harry. His company was awarded the Distinguished Unit Citation (now the Presidential Unit Citation) for its actions at outpost Harry. He submits a copy of Company B's morning report showing that he was wounded in action on 12 June 1953, a copy of his retirement certificate, a copy of his DD Form 214 (Report of Separation), a copy of the Distinguished Unit Citation narrative for Company B, and a copy of a Korean War casualty listing taken from a web site, which shows that he was wounded in action, and that he was an infantryman.

4. The applicant's military records were lost or destroyed in the National Personnel Records Center fire of 1973. Information herein was obtained from the applicant and from alternate sources.

5. The 15 January 1953 morning report of Company B, 15th Infantry Regiment, shows that the applicant was wounded in action on 12 June 1953.

6. The applicant's DD Form 214 shows that he was inducted into the Army on 21 August 1952 and retired with a permanent disability on 31 July 1954. He had 11 months and 23 days of overseas service and was awarded the Purple Heart, United Nations Service Medal, Korean Service Medal with one bronze service star, and the National Defense Service Medal. The form does not show his specialty number, but does indicate that his branch as CE (combat engineer), and that his most significant duty assignment was with the 95th Engineer Company. His retirement certificate shows his unit assignment as the 95th.

7. A web site, "Korean War Casualties, U.S. Army," shows that the applicant was an infantryman, MOS (military occupational specialty) 1745, with the 15th Infantry Regiment who was wounded in action on 12 June 1953. The data file used to compile the listing of casualties were extracted from the TAGOKOR (The Adjutant General Office Korea) file and placed on the web site. The file was purchased by the web site owner from the National Archives and Records Administration during the 3d quarter of year 2000.

8. The Unit Citation and Campaign Participation Credit Register shows that the 15th Infantry Regiment was awarded the Republic of Korea Presidential Unit Citation and the Bravery Gold Medal of Greece for its actions while the applicant was assigned to that organization.


9. The Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry MOS. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size.

CONCLUSIONS
:

1. The applicant was a combat infantryman assigned to an infantry company. He is entitled to award of the Combat Infantryman Badge.

2. The applicant's DD Form 214 should show that his branch was (IN) infantry, vice (CE) combat engineer.

3. The applicant is entitled to award of the Republic of Korea Presidential Unit Citation and the Bravery Gold Medal of Greece.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Combat Infantryman Badge, the Republic of Korea Presidential Unit Citation and the Bravery Gold Medal of Greece. His branch on his 31 July 1954 DD Form 214 should reflect IN (infantry), vice CE.
