         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his records to show award of the Combat Infantryman Badge.

3. The applicant states that he served in Vietnam during the period October 1967 through October 1968. He states that his first assignment was as a Platoon Leader of the 3rd Platoon, C Troop, 1st Squadron, 11th Armored Cavalry Regiment. He also states that his second assignment was a Senior Advisor, Mobile Advisory Team II-19, in the Van Ninh District, Khank Hoa Province, II Corps Tactical Zone in Vietnam. He further states that he instructed the local Popular Forces Platoons in the Van Ninh District on the proper use of their weapons and platoon size infantry tactics. He contends that he frequently participated in combat operations including night ambush patrols. While he was on these operations, he claims that he engaged in actual ground combat with the Vietnam Cong. In support of his application, he submits a supplemental letter, a webpage on Military Advisory Teams, a copy of Army Regulation 600-8-22, paragraph 8-6.E (Special provisions—Republic of Vietnam), his citation for award of the Army Commendation Medal, and a copy of his DA Form 66 (Officer Qualification Record).

4. The applicant’s military records show that he served as an enlisted soldier from 20 September 1965 to 3 October 1966 and was appointed as a Reserve commissioned officer on 4 October 1966. He served in Vietnam from 7 September 1969 through 6 October 1968. The applicant was honorably released from active duty on 4 April 1972.

5. The applicant's DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) does not show the Combat Infantryman Badge as an authorized award.

6. There are no orders in the applicant’s personnel records which show he was awarded the Combat Infantryman Badge.

7. The applicant's DA Form 66 shows he served as an Armored Recon Unit Commander with Troop C, 1st Squadron, 11th Armored Cavalry Regiment from October 1967 to April 1968. His DA Form 66 also shows he served as Senior Advisor with the Military Advisory Team II-19 of the United States Military Assistance Command from April 1968 to October 1968.

8. The applicant provided a copy of a citation for award of the Army Commendation Medal. This citation shows he served as a Platoon Leader of the 3rd Platoon, C Troop, 1st Squadron, 11th Armored Cavalry during his tour in Vietnam. This citation also shows he later served as a Senior Advisor of the Mobile Advisory Team II-19.

9. U.S. Military Assistance Command, Vietnam, (MACV) Directive 672-1 (Awards and Decorations) provided, in pertinent part, for award of the Combat Infantryman Badge. Appendix 3 to Annex A of this regulation listed advisor positions in MACV, which were considered infantry positions and for which award of the Combat Infantryman Badge was authorized. Senior Advisor of a Mobile Advisory Team is among those positions authorized and qualified for award of the Combat Infantryman Badge.

CONCLUSIONS:

1. Evidence of record shows the applicant served as a Senior Advisor of the Mobile Advisory Team II-19 during his tour in Vietnam. Therefore, he is entitled to award of the Combat Infantryman Badge and correction of his records to show this award.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the Combat Infantryman Badge.
