         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that item 12a (Record of Service/Date Entered Active Duty (AD) This Period) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show that he entered active duty on “24 January 1995” instead of “24 January 1991.”

3. The applicant states, in effect, that his date of entry is incorrect on his DD Form 214. His DD Form 214, dated 8 June 1996 shows him as entering AD Army while he was still on AD in the United States Navy (USN). At this time, the Veterans Administration will not accept his DD Form 214, dated 8 June 1996 for benefits due to this error. In support of his application, he submits two DD Forms 214.

4. The applicant’s military records show he entered AD on 23 November 1988 in the USN and was released from AD on 20 November 1992. He was transferred to the US Navy Reserve (USNR).

5. After a break in service, he entered AD in the Regular Army on 24 January 1995, for a period of 3 years. He continued to serve until he was honorably discharged on 8 June 1996 under the provisions of Army Regulation 635-200, chapter 16-8, due to non-retention on AD.

6. The applicant’s records contain a copy of DD Form 4 (Enlistment/Reenlistment
Document) which shows the applicant’s entry on AD date as 24 January 1995.

7. Item 12a of his DD Form 214, dated 8 June 1996, shows the entry “1991 01 24” which is incorrect.

CONCLUSIONS:

1. The evidence of record clearly shows that the applicant entered on AD in the Army on 24 January 1995. Therefore, he is entitled to correction of item 12a (Record of Service/Date Entered AD This Period) of his DD Form 214 to show the entry “1995 01 24” instead of the entry “1991 01 24.”

2. In view of the foregoing, the applicant’s records should be corrected as
recommended below.









RECOMMENDATION:

That all of the Department of the Army records related to this case for the individual concerned be corrected by showing the entry “1995 01 24 in item 12a (Record of Service/Date Entered AD This Period) of his DD Form 214, dated 8 June 1996.
