         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction to his birth date on his National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service in the Army National Guard). He states that his birth date is wrong. He submits copies of his NGB Form 22 and his birth certificate in support of his request.

3. The applicant’s records were not provided to the Board. Available information was obtained from documentation submitted by the applicant that shows he served in the South Carolina Army NG for 6 years, from 22 March 1968 to 21 March 1974. He was honorably discharged effective 21 March 1974.

4. Item 10 of his NGB Form 22 shows his birth date as 22 April 1948.

5. A Certificate of Birth issued by the State of North Carolina and submitted by the applicant shows his birth date as 22 April 1947.

CONCLUSIONS:

1. The applicant’s NGB Form 22 should be corrected to show his proper birth date as 22 April 1947. The evidence of record confirms that the erroneous entry on his separation document was due to a typographical error.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the records related to this case be corrected by showing the birth date of the individual concerned as 22 April 1947 on his NGB Form 22 and by providing him a copy of the correction.
