         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the third award of the National Defense Service Medal.

3. The applicant states that another award of the National Defense Service Medal was authorized for those on active duty on or after "September 11, 2001." He states that he is entitled to this additional award since his retirement date is 28 February 2002. In support of his application, he submits a copy of his DD Form 214 and a memorandum concerning reinstatement of the National Defense Service Medal.

4. The applicant’s military records show that he enlisted in the Regular Army on 8 February 1966 for a period of three years. He successfully completed basic and advanced individual training and was honorably released from active duty on 7 February 1969. After a break in service, he enlisted in the Regular Army on 27 February 1980. He continued to serve on active duty through a series of reenlistments and was retired in the rank of master sergeant on 28 February 2002.

5. The applicant's personnel records contain two DD Forms 214. His DD Form 214, with a separation date of 28 February 2002, shows entitlement to the second award of the National Defense Service Medal.

6. Army Regulation 600-8-22 provides, in pertinent part, that the National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 through 27 July 1954, 1 January 1961 through 14 August 1974, 2 August 1990 through 30 November 1995 and 11 September 2001 to a date to be determined. The regulation provides that the second award of the National Defense Service Medal is denoted by a bronze service star affixed to the service ribbon.

CONCLUSIONS:

1. The applicant's DD Form 214, with a separation date of 28 February 2002, shows the second award of the National Defense Service Medal as an authorized award.

2. Records show the applicant served a period of qualifying service for the third award of the National Defense Service Medal. Therefore, he is entitled to three awards of the National Defense Service Medal and correction of his records to show award of the National Defense Service Medal with two bronze service stars to denote the third award.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.
RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the National Defense Service Medal with two bronze service stars.
