         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests award of the Meritorious Service Medal and his deployment to Bosnia be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty).

3. The applicant states that the Meritorious Service Medal and his deployment to Bosnia are not shown on his DD Form 214. In support of his application, he submits a copy of his DD Form 214, a DA Form 638 (Recommendation for Award), deployment orders to Bosnia-Herzegovina, and a copy of his Officer Record Brief.

4. The applicant’s military records show that he was appointed as a Reserve commissioned officer on 18 September 1990. He was appointed in the Army National Guard on 7 June 1991 and resigned his commission on 1 August 1992. The applicant was ordered to active duty in the U.S. Army Reserve on 28 June 1996 and was honorably released from active duty on 14 July 2001.

5. The applicant's DD Form 214 does not show the Meritorious Service Medal as an authorized award.

6. The applicant provided a copy of DA Form 638, dated 21 March 2001. This document shows he was awarded the Meritorious Service Medal for meritorious service during the period 26 July 1999 to 14 July 2001 by Headquarters, Walter Reed Army Medical Center Permanent Orders Number 122-53, dated 2 May 2001.

7. The applicant also provided a copy of Headquarters, 30th Medical Brigade Permanent Orders Number 051-01 (undated), which shows the applicant's unit, 67th Combat Support Hospital, Unit 26610, was deployed to Bosnia-Herzegovina in support of Operation Joint Guard on or about 19 April 1998. There are no orders which show the specific dates he arrived at and departed from Bosnia-Herzegovina. However, his Officer Record Brief (ORB) shows in
Section IX (Assignment History) that he served in Tuzla Bosnia-Herzegovina from 17 April 1998 to 25 July 1998.

8. The applicant's personnel records contain a certificate for award of the North Atlantic Treaty Organization (NATO) Medal for service with NATO operations in relation to the former Yugoslavia during the period 8 April 1998 to 25 July 1998.

CONCLUSIONS:

1. Orders show the applicant was awarded the Meritorious Service Medal for meritorious service during the period 26 July 1999 to 14 July 2001. Therefore, his DD Form 214 will be corrected to show award of the Meritorious Service Medal.

2. There is no evidence which shows the applicant's exact dates in Bosnia. However, his ORB shows he served in Tuzla (Bosnia-Herzegovina) from 17 April 1998 to 25 July 1998.

3. Based on the available records, the Board determined that item 18 (Remarks) on the applicant's DD Form 214 should be amended to show the entry “Bosnia Service: 17April 1998 – 25 July 1998.”

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected:

a. by showing the individual concerned was awarded the Meritorious Service Medal; and

b. by amending item 18 (Remarks) to show the entry "Bosnia Service: 17 April 1998 – 25 July 1998.”
