APPLICANT REQUESTS: In effect, that the Social Security Account Number (SSAN) contained in his military records be corrected.
APPLICANT STATES: In effect, that when he enlisted in the Army, the SSAN of one of his sons was used by mistake. He claims that the SSAN is properly recorded in his Navy records, and that he was under the impression that the Department of Veterans Affairs (DVA) was getting it changed. In support of his application, he provides a copy of his Social Security Card (SSC) and a DVA rating decision letter.
EVIDENCE OF RECORD: The applicant's military records show:
On 19 September 1989, the applicant enlisted in the Regular Army for 4 years. His Enlistment Contract (DD Form 4) contains the same SSAN that is recorded in his Personnel Qualification Record (DA Form 2-1), which was created on
21 September 1989, upon his entry on active duty, and last reviewed by the applicant on 23 September 1993.
On 24 September 1993, the applicant reenlisted for 4 years while serving at Fort Hood, Texas. The DD Form 4 created for this enlistment also contains the same SSAN recorded in his previous enlistment contract and in his personnel record.
All orders, documents, and other information on file in the applicant’s Military Personnel Records Jacket (MPRJ), many of which were authenticated by the applicant with his signature, also all contain the same SSAN contained in the applicant’s enlistment contract and Personnel Qualification Record, which he used throughout his tenure on active duty.
On 1 February 1995, the applicant was honorably released from active duty after completing a total of 5 years, 4 months, and 13 days of active military service in the Army. The separation document (DD Form 214) issued to and authenticated by him on the date of his separation lists the same SSAN that was recorded in all his personnel records and enlistment contracts.
In support of his application, he provides a copy of a SSC which lists a SSAN that is different from the one recorded in his military records. He also provides a copy of a DVA rating decision that lists the same SSAN that is recorded in his military records, but is lined through and listed as a duplicate.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. The Board notes the applicant’s contention that the SSAN listed in his military records and on his 1 February 1995 DD Form 214 should be changed. However, it finds insufficient evidence to support this claim. Although the applicant now claims that the SSAN contained in the SSC he provided is correct, and the one recorded in his military records is incorrect, he fails to provide an official explanation from the Social Security Administration, or any other source, to explain the use of these duplicate SSANs.
2. The evidence of record clearly shows that the applicant’s active duty service was performed under the SSAN he now claims was in error, and that this SSAN was the one recorded in his enlistment contract, the military records prepared on him upon his entry on active duty, and in orders and documents prepared on him throughout his tenure on active duty, many of which he authenticated with his signature.
3. For historical purposes, the Army has an interest in maintaining the accuracy of its records. The information contained therein should reflect the conditions and circumstances that existed at the time the records were created and under which the military service was performed. Therefore, the Board concludes that the SSAN contained in the applicant’s military records and in his
1 February 1995 separation document should not be changed.
4. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
