         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that her DD Form 4/1 (Enlistment/Reenlistment Document) be corrected to show her date of enlistment as 20 November 2000.

3. The applicant states that block 5 (Date of Enlistment) of her DD Form 4/1 is blank and should be corrected to reflect her enlistment date of 20 November 2000.

4. The applicant’s military records show that she initially enlisted in the U.S. Army Reserve (USAR) on 1 August 1986, for a period of 8 years. On
30 December 1986 she requested discharge from the delayed entry program and enlisted in the Regular Army for a period of 3 years.

On 12 November 1991, she was discharged upon expiration of term of service and was transferred back to the U. S. Army Reserve (USAR).

5. On 17 February 1995 she reenlisted in USAR for a period of 6 years, and served on active duty from 14 December 1995 to 25 August 1996.

6. The applicant’s DD Form 4/2 (Enlistment/Reenlistment Document) section D (Certification and Acceptance) and section E (Confirmation of Enlistment or Reenlistment) indicates the applicant reenlisted on 20 November 2000.

7. The applicant’s DD From 3540 (Certificate and Acknowledgment of U.S. Army Reserve Service Requirement and Methods of Fulfillment) indicates that the applicant signed her service obligation agreement on 20 November 2000. The DD Form 3540 is completed when an individual enlists, reenlists, is transferred, or reassigned. The applicant’s certificate indicates the reason for completing the certificate was her immediate reenlistment in the U.S. Army Reserve.

CONCLUSIONS:

1. Evidence shows the applicant reenlisted in the USAR on 20 November 2000, and her DD form 4/1 (Enlistment Document) section A (Enlistee/Reenlistee Identification Data), item 5 (Date of Enlistment), should read 20001120.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.






RECOMMENDATION
:

That all of the Department of the Army records related to this case be corrected by changing the applicant DD Form 4/1, section A, item 5 to read 20001120.
