         The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military records

         Exhibit B - Military Personnel Records (including advisory opinion, if any)


2. The applicant requests that his DD Form 214 (Report of Transfer or Discharge) be corrected to show that he was a specialist five (SP5), pay grade (E-5), at the time of his discharge.

3. The applicant states, in effect, that Letter Orders Number S-07-5051910, dated 10 July 1970, show that he was a SP5, as do his discharge orders.

4. The applicant entered active duty on 9 August 1967. He successfully completed training and served in Korea until his early release from active duty as an overseas returnee, on 12 March 1969.

5. The applicant's DD Form 214 shows his rank, at the time of discharge, as specialist four, temporary, and that he was transferred to the USAR Control Group (Annual Training), St. Louis, Missouri.

6. The applicant's DA Form 20 (Enlisted Qualification Record) shows that he was promoted to private (E-2) on 9 December 1967, to private first class (E-3) on 1 April 1968, and to specialist four (E-4) temporary on 13 September 1968. The orders for these promotions are of record and are consistent with entries on the DA Form 20.

7. The Headquarters, US Army Personnel Center, Fort Lewis, Washington, Special Orders Number 71, dated 12 March 1969, that authorized the applicant's release from active duty, shows him as a SP5.

8. Office of the Adjutant General, US Army Administration Center, Letter Orders Number S-07-5051910 directed the applicant to report for duty (annual training) on 7 June 1970 and amended the earlier orders (Letter Orders Number S-04-4014615) to show his pay grade as E-5.

9. In June 1970, a search of the applicant's unit's morning reports was requested on the issue of his pay grade. A USAAC (US Army Administrative Center) Form 368 (Report of Morning Report Search) shows that the applicant was promoted to specialist four (SP4) on 13 September 1968 and to specialist five (SP5) on 14 February 1969.

10. The applicant is shown to have served in a Reserve capacity as an SP5 from the date of his transfer from active duty through the completion of his obligated period of service.

CONCLUSIONS:

1. The Board concludes that the applicant was promoted to pay grade E-5 prior to his transfer to the US Army Reserve.


2. Therefore, the Board concludes that the record supports that he was promoted to SP5 (E-5) while on active duty and that it is appropriate to correct his records to show this promotion and his release from active duty in the rank and pay grade of specialist five, E-5.

3. In view of the foregoing findings and conclusions, correcting the applicant’s records as recommended below will correct an error.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was promoted to specialist five (E-5) on 14 February 1969 and was released form active duty in that pay grade.
