         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show the Army Commendation Medal, the Army Achievement Medal and the Overseas Service Ribbon as authorized awards on his DD Form 214 (Certificate of Release or Discharge from Active Duty). He also requests that item 12e of his DD Form 214 be corrected to show 1 year of foreign service in Korea and that items 7b and 19a and 19b be corrected to show the address as 721 "Pleasant Hills Drive" vice "Pleasant Hill Road."

3. The applicant states that the approved orders show his entitlement to the Army Commendation Medal and the Army Achievement Medal and that his orders to Korea verify his foreign service.

4. The applicant’s military records show that he enlisted in the Army Reserve (USAR) on 8 November 1985. His home of record, mailing address and the address of his next of kin was 721 Pleasant Hills Drive. He completed initial active duty training as one site unit training and was released to his unit. He was ordered to active duty on 20 June 1998 and enlisted in the Regular Army for 3 years and a guaranteed duty in Korea.

5. The transfer orders show that he was to report to the 1st Adjutant General Replacement Detachment (Korea) on 30 October 1998. An endorsement to those orders show that, effective 22 October 1998 the applicant was attached to the Headquarters Support Company, 168th Medical Battalion.

6. A DA Form 638 (Recommendation for Award), initiated 4 February 1999, recommended that the applicant be awarded the Army Achievement Medal for the period 26 October through 30 December 1998. The recommendation was approved on 23 February 1999 and "Permanent Orders Number 055-2" is noted in Part V (Orders Data). Another DA Form 638 was initiated on 28 July 1999. It recommended that the applicant be awarded the Army Commendation Medal for meritorious service for the period 19 October 1998 to 19 October 1999. The recommendation was approved on 27 September 1999 and "Permanent Orders Number 246-03" is noted in Part V. Both recommendations show the applicant's unit as Headquarters Support Company, 168th Medical Battalion located at Army Post Office, Area Pacific 96218, which is in Korea.

7. There are no available records reflecting the applicant's return to the United States. However, he was stationed at the Andrew Rader Health Center, Fort Myer, Virginia where he was awarded the Good Conduct Medal on 5 July 2000 and was separated on 30 September 2001. He was released from active duty and transferred to the Army Reserve Control Group (Reinforcement).


8. His DD Form 214 does not list the Army Commendation Medal, the Army Achievement Medal or the Overseas Service Ribbon as authorized. It indicates that he had no foreign service and that his address was " 721 Pleasant Hills RD."

9. Army Regulation 600-8-22 shows that the Secretary of the Army established the Overseas Service Ribbon on 10 April 1981. The regulation states, in pertinent part, that effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award for successful completion of overseas tours. The award may be awarded retroactively to those personnel who were credited with a normal overseas tour completion before 1 August 1981 provided they had an Active Army status on or after 1 August 1981 and the overseas service is not recognized with another U.S. service medal. Numerals are used to denote the second and subsequent awards of the Overseas Service Ribbon.

CONCLUSIONS:

1. The applicant was awarded the Army Achievement Medal and the Army Commendation Medal and those awards should be reflected on his DD Form 214.

2. He completed a tour of duty in Korea and is entitled to award of the Overseas Service Ribbon.

3. It is impossible to tell from the available records exactly when he arrived and departed Korea but the available records indicate that he served with the Headquarters Support Company, 168th Medical Battalion from 19 October 1998 to 19 October 1999 a period of 1 year and 1 day. That period should be reflected in block 12f (Foreign Service) of his DD Form 214.

4. His Home of Record (block 7b of the DD Form 214), mailing address (block 19a, and the address of his next-of-kin is 721 Pleasant Hills Drive.

5. In view of the foregoing findings and conclusions, correcting the applicant’s records as indicated below would correct errors.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing on the DD Form 214 of the individual concerned that:

         a. he was awarded the Army Commendation Medal, the Army Achievement Medal and the Overseas Service Ribbon;

         b. he served overseas in Korea for 1 year and 1 day, and;

         c. his home of record , mailing address and the address of his next of kin was 721 Pleasant Hills Drive vice Pleasant Hills Road.

2. That so much of the application as is in excess of the foregoing be denied.
