      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that his discharge be upgraded to
honorable and that he be awarded all awards, medals, and any other
decorations he owns. He also requests that his service records show his
correct service periods.

2.  The applicant states, in effect, his DD Form 214, Certificate of
Release or Discharge from Active Duty, does not show correct information
in Items 11, (Primary Specialty), 12 (Record of Service), 13 (Decorations,
Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), 14
(Military Education), and 18 (Remarks).  The applicant adds that his
record should also reflect that he has a National Defense Service Medal,
Army Service Ribbon, and a Mississippi War Medal and an Overseas Service
Ribbon.

3.  The applicant states in an addendum to his DD Form 149, Application
for Correction of Military Record, in effect, that there were issues
prior to his discharge. All of this started due to the fact he wanted to
see his first child being born.  His chain of command did not properly
handle the situation.  He was taken out of his house away from his nine-
month pregnant wife and told that he couldn't take her to the hospital.
This broke him.  At the moment he decided he didn't want to serve under
that command anymore.  Although he does regret leaving the military, he
must say, it was the best time of his life.  He states he has since gone
on and straightened out his life.  He has three sons and a newborn
daughter.  He wants a great life for his children, as does any parent.
He is currently trying to get back into college but can't afford it.  He
feels that he has served his time, paid for the GI Bill, and should be
able to raise his family.  Only problem is that his discharge follows him
and makes his life and his family's difficult.  Also, he would love to go
back into active service to once again have a sense of pride and dignity
and to be able to show his three sons that their daddy is the best.  He
asks the Board to please grant him this upgrade so that he can continue
to further himself, his life, his career, his education, and parenthood.

4.  He summarized his comments on the DD Form 149 by stating that his
entire life was torn apart and turned upside down because a NCO
(noncommissioned officer) lied to the 1SG (First Sergeant) and CO
(Commanding Officer), of his company, and his life has been hard ever
since.

5.  In support of his request, the applicant provides those documents that
he has indicated on his DD Form 149.
CONSIDERATION OF EVIDENCE:

1.  The applicant is requesting correction of an alleged injustice that
occurred on 20 March 2002.  The application submitted in this case is dated
31 October 2006.

2.  Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice.  This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitation if the ABCMR determines that it
would be in the interest of justice to do so.  In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.

3.  The evidence shows the applicant enlisted in the Mississippi Army
National Guard (MSARNG), and the Reserve of the Army, on 30 January 1995.
He was honorably discharged from the MSARNG on 5 April 1998, in the rank
and pay grade, Specialist, E-4, for enlistment in the Regular Army, under
the provisions of National Guard Regulation 600-200, Paragraph 8-26A(2).

4.  The applicant was issued a NGB Form 22, Report of Separation and
Record of Service, on the date of his discharge.  Item 10 (Record of
Service) shows the applicant was credited with 3 years, 2 months, and 6
days net service.  Item 12 (Military Education) shows he completed a 5-
week Motor Transport Operators Course in July 1995.  Item 15 (Decorations,
Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded This
Period (State Awards May be Included) shows he was awarded the Army
Service Ribbon, the National Defense Service Medal, and the Mississippi
War Medal.  Item 13 (Primary Specialty Number, Title and Date Awarded)
shows the following entry:  "88M10, Motor Transport Opr, 950707."  Item 18
(Remarks) shows the applicant was issued a DD Form 214 for the period 8
March 1995 through 7 July 1995.

5.  The applicant enlisted in the Regular Army on 6 April 1998.  He was
honorably discharged, in the rank of Specialist, on 11 May 2000, for the
purpose of immediate reenlistment.

6.  The applicant reenlisted in the Regular Army on 12 May 2000.  All the
applicant's National Guard and Regular Army personnel records are not
available.
7.  The evidence of record shows the applicant was discharged with a
discharge characterized as under other than honorable conditions, in the
rank and pay grade of Private, E-1, on 20 March 2002, under the
provisions of Army Regulation (AR) 635-200, Chapter 10, in lieu of trial
by court-martial.

8.  There is no evidence that the applicant applied to the Army Discharge
Review Board (ADRB) for an upgrade of his discharge within its 15-year
statute of limitations.

9.  Since the applicant has not exhausted administrative remedies available
to him by applying to the Army Discharge Review Board for a review and the
possible upgrade of his discharge characterized as under other than
honorable conditions, his request for an upgrade of his discharge will not
be further addressed in this Record of Proceedings.  The applicant has been
notified of procedures and provided an appropriate form to initiate this
action if he still desires an upgrade of his discharge.

10.  When the applicant was discharged, he was discharged with temporary
records. He has provided sufficient documents related to his request for
correction of his record to enable addressing the applicant's request for
correction of his record.

11.  The applicant was awarded the Army Achievement Medal, for meritorious
achievement, by Permanent Orders 272-13, published by Headquarters, 2nd
Battalion, 9th Infantry (Mechanized), in Korea, on 30 September 1998.  This
award is not shown on the applicant's DD Form 214.

12.  The applicant was awarded the Army Commendation Medal, for meritorious
service, by Permanent Orders 008-01, published by Headquarters, 1st
Brigade, 2nd Infantry Division, in Korea, on 8 February 1999.  The
applicable DA Form 638, Recommendation for Award, shows this award was made
on his departure from Korea where he served from 25 April 1998 to 24 April
1999.  This award is not shown on the applicant's DD Form 214.

13.  The applicant provided a certificate of training for completion of a
Drivers Training Course, of 40 hours duration, which he attended for the
period 17 May through 21 May 1999.  He completed this course at Fort Sill,
Oklahoma.

14.  The applicant provided a certificate of training for completion of the
Palletized Load System (PLS) Course, which he attended for the period 1
June through 9 June 1999.  He completed this course at Fort Sill.

15.  The applicant provided a certificate of recognition for completion of
the Hazardous Material/Waste Handling and Emergency Response (Integrated)
Course, which he completed on 17 December 1999.  This course was 40 hours
in duration.  He completed this course at Fort Sill.

16.  The applicant was awarded the Driver and Mechanic Badge, with W-Bar,
by Permanent Orders 306-09, 19th Maintenance Battalion, Fort Sill, dated
1 November 2000.  This badge is not shown on his DD Form 214.

17.  The applicant provided a course completion certificate for completion
of the Field Sanitation Team Certification Course, a course of 40 hours
duration, which he attended for the period 11 December through 15 December
2000.  This course was presented at Fort Sill, by the Academy of Health
Sciences, Fort Sam Houston, Texas.

18.  Item 11, of the applicant's DD Form 214, has the entry, "None //
Nothing Follows."

19.  The applicant's DD Form 214, in Item 12.c. shows that on the date of
his discharge, he had completed 1 years, 6 months, and 4 days, creditable
active military service on his current enlistment.

20.  The applicant's DD Form 214 shows in Items 12.d. (Total Prior Active
Service), he had completed 0000 / 00 / 00 total prior active service.

21.  The applicant's DD Form 214 shows in Item 12.e. (Total Prior Inactive
Service), he had completed 0000 / 00 / 00 total prior inactive service.

22.  The applicant's DD Form 214 shows in Item 12.f. (Foreign Service), he
had completed 0000 / 00 / 00 total foreign service.

23.  The applicant's DD Form 214 shows in Item 12.g. (Sea Service) he had
completed no sea service.  There is no evidence the applicant had any sea
service therefore, this issue will not be addressed further in this Record
of Proceedings.

24.  The evidence shows the applicant served in the MSARNG from 30
January through 7 March 1995.  He was ordered to active duty for training
on 8 March and was released from IADT on 7 July 1995.  He returned to the
MSARNG on 8 July 1995 and served honorably until 5 April 1998.  He was
discharged from the MSARNG on this date and enlisted in the Regular Army
on 6 April 1998.  He was
honorably discharged for the purpose of immediate reenlistment in the
Regular Army on 11 May 2000.  The applicant reenlisted in the Regular
Army and served on active duty until he was discharged under the
provisions of AR 635-200, Chapter 10, on 20 March 2002.  The applicant
had lost time from 4 April 2001 through 6 August 2001 due to AWOL.  A
notation was made in Item 18 that he was separated from service on
temporary records and his affidavit.  A DD Form 215, Correction to DD
Form 214, was to be issued to provide the missing information.

25.  Item 13, of the applicant's DD Form 214, has the entry, "None //
Nothing Follows."

26.  Item 14, of the applicant's DD Form 214, has the entry, "None //
Nothing Follows."

27.  In his application to the Board, the applicant alleges he "paid for
the GI Bill."  Item 15.a. (Member Contributed to Post Viet Nam Era
Veteran's Educational Assistance Program), of the applicant's DD Form 214,
show an "X" entered in the column indicating a, "No" for an answer.

28.  AR 600-8-22, as amended, provides that the National Defense Service
Medal is awarded for honorable active service (emphasis added) for any
period between 27 July 1950 through 27 July 1954, 1 January 1961 through
14 August 1974, 2 August 1990 through 30 November 1995 and 11 September
2001 to a date to be determined.  This regulation also provides that the
second and subsequent awards of the National Defense Service Medal are
denoted by a bronze service star affixed to the National Defense Service
Medal.  To signify receipt of a second or subsequent award of the National
Defense Service Medal, a service star will be worn on the service ribbon
by U.S. Army personnel so qualified.

29.  AR 600-8-22 shows that the Army Service Ribbon was established by the
Secretary of the Army on 10 April 1981.  This regulation states, in
pertinent part, that effective 1 August 1981, all members of the Active
Army, Army National Guard, and Army Reserve in an active Reserve status are
eligible for the award upon successful completion of initial entry
training.  The award may be awarded retroactively to those personnel who
completed the required training before 1 August 1981 provided they had an
Active Army status on or after 1 August 1981.

30.  AR 600-8-22 shows that the Overseas Service Ribbon was established by
the Secretary of the Army on 10 April 1981.  The regulation states, in
pertinent
part, that effective 1 August 1981, all members of the Active Army, Army
National Guard, and Army Reserve, in an active Reserve status, are eligible
for the award for successful completion of overseas tours.  The award may
be awarded retroactively to those personnel who were credited with a normal
overseas tour completion before 1 August 1981 provided they had an Active
Army status on or after 1 August 1981 and the overseas service is not
recognized with another U.S. service medal.

31.  Army Human Resources Command Message (Date Time Group 9 February
2004) published implementing instructions for award of the Korea Defense
Service Medal.  This message specified criteria for award of the Korea
Defense Service Medal as follows:  a) service members of the armed forces
must have served in support of the defense of the Republic of Korea from
28 July 1954 through a future date to be determined by the Secretary of
Defense;  b) the area of eligibility encompasses all land area of the
Republic of Korea, and the contiguous water out to 12 nautical miles, and
all air spaces above the land and water areas;  c) service members must
have been mobilized with units or assigned or attached to units operating
in the area of eligibility and have been physically deployed in the area
of eligibility for 30 consecutive or 60 non-consecutive days.  The
implementing message also authorized award of the Korea Defense Service
Medal if a Soldier meets one or more of the following criteria:  a) be
engaged in actual combat during an armed engagement, regardless of the
time in the area of eligibility;  b) is wounded or injured in the line of
duty and requires medical evacuation from the area of eligibility;  c)
participates as a regularly assigned air crew member flying sorties for
30 consecutive days or 60 nonconsecutive days into, out of, within, or
over the area of eligibility in support of military operations; or  d)
served in operations and exercises conducted in the area of eligibility
as long as the basic time criteria is met.  The message further provided
that, due to extensive time period for the Korea Defense Service Medal
eligibility, the non-consecutive service period for eligibility remains
cumulative throughout the entire period.

32.  DD Form 214 was not issued to active duty personnel, other than to
member of the AUS, who were discharged and reenlisted between the period
22 July 1952 and 24 February 1957 and active duty personnel who were
discharged and reenlisted subsequent to 1 October 1979 and the next DD
Form 214 "From" date does not cover period of prior enlistments.
(Discharge Certificates, however, were issued to all personnel.)  For
service involving the above period, DD Form 215 is prepared correcting DD
Form 214 issued at time of next separation to show all military service
not previously covered by the DD Form 214.
33.  AR 635-5 prescribes the separation documents which are prepared for
individuals upon retirement, discharge, or release from active military
service or control of the Army.  It establishes standardized policy for
preparing and distributing the DD Form 214.  The DD Form 214 is a summary
of a Soldier's most recent period of continuous active duty.  It provides a
clear-cut record of active duty service at the time of release from active
duty, retirement, or discharge.

34.  AR 635-5 (paragraph 2-1.b.) specifies that a DD Form 214 will not be
prepared for enlisted Soldiers discharged for immediate reenlistment in
the Regular Army.  This same regulatory guidance was prescribed in the
edition of AR 635-5 in force at the time of the applicant's discharge on
11 May 2000.

35.  AR 635-5, paragraph 2-4 provides instructions for the completion of
items that appear on the DD Form 214.  Instructions for the completion of
Item 12 (Record of Service), Item 13 (Decorations, Medal, Badges,
Citations and Campaign Ribbons Awarded or Authorized (All Periods of
Service), Item 14 (Military Education), and Item 18 (Remarks) are as
follow:

      a.  Item 12.a. (Date Entered Active Duty (AD) This Period). Enter the
beginning date of the continuous period of AD for issuance of this DD Form
214, for which a DD Form 214 was not previously issued.

      b.  Item 12.c. (Net Active Service This Period). Amount of service
this period, computed by subtracting item 12.a. from 12.b.  Lost time under
Title 10, United States Code 972 and non-creditable time after ETS, if any,
are deducted. Such time will be identified in Item 18 (Remarks).

      c.  Item 12.d. (Total Prior Active Service).  From previously issued
DD Forms 214, enter total amount of prior active military service, less
lost time, if any.  If not applicable, enter "00 00 00."

      d.  Item 12.e. (Total Prior Inactive Service).  From previously
issued DD Forms 214 and/or ERB/ORB (Enlisted Record Brief/Officer Record
Brief), enter the total amount of prior inactive service, less lost time,
if any.  DEP time that began on or after 1 January 1985 is not creditable
service for pay purposes and will not be entered in this block.  However,
it is creditable service for completing the statutory military service
obligation, and will be entered in Item 18.

      e.  Item 12.f. (Foreign Service).  From the ERB/ORB, enter the total
amount of foreign service completed during the period covered in Item 12.c.


      f.  Item 13.  The above regulation provides that decorations, medals,
badges, citations and campaign ribbons, will be entered from information
recorded on the ERB/ORB.

      g.  Item 14 (Military Education).  From the ERB/ORB, list in-service
(full-time attendance) training courses successfully completed during the
period of service covered by the DD Form 214.  This information is to
assist the member after separation in job placement and counseling;
therefore, do not list training courses for combat skills.

      h.  Item 18 (Remarks).  Use this block for HQDA mandatory
requirements when a separate block is not available, and as a continuation
for other entries.

            1)  "Mandatory entry: 'SOLDIER (HAS) (HAS NOT) COMPLETED FIRST
FULL TERM OF SERVICE.'  This information assists the State in determining
eligibility for unemployment compensation entitlement.  The following
guidance will help determine which entry to use:

            (a) Routinely, a Soldier should not be considered to have
completed the first full term of active service if separation occurs before
the end of the initial contracted period of service.  However, if a Soldier
reenlists before the completion of that period of service, the first term
of service is effectively redefined by virtue of the reenlistment contract.


            (b) To determine if an enlisted Soldier has completed the first
full term of enlistment, refer to the enlistment/reenlistment documents and
compare the term(s) of enlistment to the net service in block 12c of the DD
Form 214.  If Soldier has completed or exceeded the initial enlistment,
enter 'has."  If item 12c of the DD Form 214 is less than the Soldier's
initial enlistment, enter 'has not.'"

            2)  For enlisted Soldiers with more than one enlistment period
during the time covered by this DD Form 214, enter "IMMEDIATE
REENLISTMENTS THIS PERIOD" (specify dates).  However, for Soldiers who
have previously reenlisted without being issued a DD Form 214 and are
separated with any characterization of service except "Honorable," enter
"Continuous Honorable Active Service From" (first day of service which DD
Form 214 was not issued) Until (date before commencement of current
enlistment).  Then, enter the specific periods of reenlistments as
prescribed above.
DISCUSSION AND CONCLUSIONS:

1.  The evidence of record shows the applicant completed training which led
to award of an MOS and was released from active duty for training on 7 July
1995.  His NGB Form 22 shows he was awarded the MOS 88M (Motor Transport
Operator) and served in this MOS.  He is therefore entitled to have this
MOS added to Item 11 of his DD Form 214 and to show he served in this MOS
for 6 years and 4 months, which excludes the time he lost due to AWOL.

2.  The evidence confirms the applicant enlisted in the Regular Army on 6
April 1998.  The date currently shown in Item 12.a. of his DD Form 214,
with an effective date of discharge of 20 March 2002 is incorrect.  He is
entitled to a correction of this item on his DD Form 214 to show the date:
1998 / 04 / 06.

3.  The applicant's last enlistment covered by the DD Form 214 issued him
on his discharge extended from 12 May 2000 through 20 March 2002, a period
of 1 year, 6 months and 6 days, less lost time for the period 4 April 2001
through 6 August 2001.

4.  On the date of his reenlistment on his current period of service, the
applicant had completed 2 years, 5 months, and 6 days active duty service.
The total prior active service currently shown in Item 12.d. of his DD Form
214, with an effective date of discharge of 20 March 2002 is incorrect.  He
is entitled to a correction of this item on his DD Form 214 to show he had:
 0002 / 05 / 06 total prior active service.

5.  Before his enlistment in the Regular Army, the applicant had completed
2 years, 10 months, and 7 days inactive service.  The total prior inactive
service currently shown in Item 12.e. of his DD Form 214, with an effective
date of discharge of 20 March 2002 is incorrect.  He is entitled to a
correction of this item on his DD Form 214 to show he had:  0002 / 10 / 07
total prior inactive service.

6.  During his first enlistment period in the Regular Army, the applicant
completed a one year tour of duty in Korea.  Item 12.f. of his DD Form 214,
with an effective date of discharge of 20 March 2002, currently shows no
overseas service.  He is entitled to a correction of this item on his DD
Form 214 to show he had:  0001 / 00 / 00 foreign service.

7.  The applicant is entitled to have the already-awarded National Defense
Service Medal and the Army Service Ribbon which are shown on his NGB Form
22 added to his DD Form 214.

8.  The applicant served in part during a period for which the National
Defense Service Medal can be awarded for honorable service [he served
from 11 September 2001 until he was discharged on 20 March 2002,
excluding his recorded periods of time lost due to AWOL].  He is not
entitled to award of a second National Defense Service Medal, in effect,
the National Defense Service Medal, with oak leaf cluster, for any period
of its last authorization, 11 September 2001 to a date to be determined,
because his service was characterized as under other than honorable
conditions on his discharge.  The National Defense Service Medal is
awarded for honorable service.

9.  The applicant met the criteria for award of the Overseas Service Ribbon
and the Korea Defense Service Medal for his successful completion of an
overseas tour of duty in Korea.  This ribbon and medal are not shown on his
DD Form 214. He is entitled to these awards and to have them added to his
DD Form 214.

10.  The applicant is entitled to have the already-awarded Army
Commendation Medal, the Army Achievement Medal, and the Driver and Mechanic
Badge, with W-Bar, added to his DD Form 214.

11.  The evidence shows the applicant completed the following courses which
are qualified for entry in Item 14, of his DD Form 214, with an effective
date of discharge of 20 March 2002.  The:

      a.  Drivers Training Course / 1week / May 1999;

      b.  Palletized Load System (PLS) Course / 2 weeks / June 1999;

      c.  Hazardous Material/Waste Handling and Emergency Response
(Integrated) Course / 1 week / December 1999; and

      d.  Field Sanitation Team Certification Course / 1 week / December
2000.

12.  In his application to the Board, the applicant alleges he "paid for
the GI Bill"; however, the evidence shows he did not participate in the
Post-Vietnam Era Veteran's Educational Assistance Program.  The applicant
is advised to visit with a representative of the Department of Veterans
Affairs to determine which of a wide array of veterans' programs and
benefits he may be entitled to as a result of his service before his
discharge characterized as under other than honorable conditions.
13.  The evidence of record shows the applicant enlisted in the Regular
Army for 3 years, on 6 April 1998.  He was honorably discharged, in the
rank of Specialist, on 11 May 2000, for the purpose of immediate
reenlistment.  He was discharged from the Army on 20 March 2002.  The
service he completed during his first enlistment in the Regular Army is not
shown on his DD Form 214 because he was discharged on temporary records.
He is entitled to have this service shown in the Remarks Section of his DD
Form 214 in accordance with the applicable regulation.

14.  The applicant's DD Form 214, in the remarks section has the
statement, "Member has not completed first full term of service."  The
applicant completed his first full term of service on 5 April 2001.
Routinely, a Soldier should not be considered to have completed the first
full term of active service if separation occurs before the end of the
initial contracted period of service; however, if a Soldier reenlists
before the completion of that period of service, the first term of service
is redefined by virtue of the reenlistment contract.  The statement that
now appears in the Remarks Section of the applicant's DD Form 214 is
incorrect and he is entitled to a correction to show he did complete his
first full term of service.

15.  The applicant served in Korea for the period from 25 April 1998 to 24
April 1999.  This overseas service was completed prior to the beginning
date of his last enlistment contract.  AR 635-5 precluded his service from
being shown in Item 12.f. of his DD Form 214; however, as a matter of
equity, this service should be entered in the remarks section of the DD
Form 214.

16.  Records show the applicant should have discovered the alleged error or
injustice now under consideration on 20 March 2002; therefore, the time for
the applicant to file a request for correction of any error or injustice
expired on 19 March 2005.  However, the applicant did not file within the 3-
year statute of limitations and has provided a compelling explanation or
evidence to show that it would be in the interest of justice to excuse
failure to timely file in this case.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief and to excuse failure to timely
file.  As a result, the Board recommends that all Department of the Army
records of the individual concerned be corrected by correcting [Note:  all
items indicated for correction are shown on the applicant's DD Form 214,
with an effective date of his discharge of 20 March 2002]:

      a.  Item 11 to show the entry:  88M10 / Motor Transport Operator / 6
years and 4 months;

      b.  Item 12.a. to show the entry:  1998 / 04 / 06;

      c.  Item 12.c. to show the entry:  0001 / 06 / 06

      d.  Item 12.d. to show the entry:  0002 / 05 / 06;

      e.  Item 12.e. to show the entry:  0002 / 10 / 07;

      f.  Item 12.f. to show the entry:  0001 / 00 / 00;

      g.  Item 13 to add the already-awarded National Defense Service Medal
and the Army Service Ribbon, which are shown on his NGB Form 22, and the
already-awarded Army Commendation Medal, Army Achievement Medal, and the
Driver and Mechanic Badge, with "W" Bar, to the applicant's DD Form 214;

      h.  to award the applicant the Overseas Service Ribbon and the Korea
Defense Service Medal, for his successful completion of an overseas tour of
