         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his records to show award of the Overseas Service Ribbon, the Armed Forces Reserve Medal, and the Excellence in Competition Badge.

3. The applicant states that he should receive retroactive award of the Overseas Service Ribbon based on his service in the Ryukyus Command from 1952 to 1953 and his subsequent active duty in support of Operation Desert Storm in 1991. The applicant also states, in effect, that his DD Form 214 with a separation date of 14 March 1991 does not show his award of the Armed Forces Reserve Medal or his award of the Excellence-in Competition Badge-Bronze-Pistol.

4. The applicant’s military records show that he entered active duty as a commissioned officer on 6 July 1951 and was honorably separated from active duty in the rank of first lieutenant on 9 July 1953. He subsequently served in the Army Reserve and the Army National Guard and was transferred to the Retired Reserve effective 2 July 1979 in the rank of lieutenant colonel.

5. The applicant was recalled from the Retired Reserve and ordered to active duty effective 12 February 1991 in support of Operation Desert Storm. He was released from active duty and returned to the Retired Reserve effective 14 March 1991.

6. The applicant’s DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 14 March 1991, does not show the Overseas Service Ribbon, the Armed Forces Reserve Medal, or the Excellence-in Competition Badge-Bronze-Pistol.

7. The applicant’s records show that he served for 13 months in the Ryukyus Command from 13 May 1952 to 24 June 1953. Records also indicate that the applicant completed a normal permanent change of station tour of duty.

8. The applicant’s service personnel records contain Decorations and Awards Action Sheet which shows that he was awarded the Armed Forces Reserve Medal. However, there is no indication that the applicant was awarded the appropriate “Hourglass” Devices or the “M” Device to be worn on his Armed Forces Reserve Medal.

9. Retirement Points Accounting Statements in the applicant’s service personnel records show that, during his reserve service from 1953 to 1979, he completed only one 10-year period of service during which he earned 50 or more retirement points each year within a period of 12 consecutive years of reserve service.

10. The applicant’s service personnel records contain Headquarters United States Continental Army Command Special Orders Number 3 which awarded the applicant the Excellence-in Competition Badge-Bronze-Pistol.

11. Army Regulation 600-8-22 shows that the Overseas Service Ribbon was established by the Secretary of the Army on 10 April 1981. The regulation states, in pertinent part, that effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award for successful completion of overseas tours. The award may be awarded retroactively to those personnel who were credited with a normal overseas tour completion before 1 August 1981 provided they had an Active Army status on or after 1 August 1981 and the overseas service is not recognized with another U.S. service medal. Numerals are used to denote the second and subsequent awards of the Overseas Service Ribbon.

12. Army Regulation 600-8-22 (Military Awards), as amended by Military Personnel Message Number 96-196, provides for award of the Armed Forces Reserve Medal (AFRM). It is awarded for honorable and satisfactory service as a member of one or more of the Reserve Components of the Armed Forces of the United States for a period of 10 years. The conditions for award of the AFRM require that a minimum of 50 retirement points be earned for each of the 10 qualifying years and that the qualifying service be completed within 12 consecutive years. Service in a regular component of the Armed Forces, tenure in elected state office, tenure as a member of a legislative body of the United States or a state, and service as a judge of a court of record of the United States, a state or territory or District of Columbia is excluded from credit toward this award but does not constitute a break in service. The Ten-year Device (hourglass with Roman numeral “X”) is authorized for wear on the AFRM to denote each succeeding 10-year period of Reserve Component service. The first 10 years is denoted by a bronze hourglass, the second 10-year period of Reserve Component service is denoted by a silver hourglass and the third by a gold hourglass. Forty years of Reserve Component service is recognized by a gold hourglass followed by a bronze hourglass on the AFRM. The “M” Device will be worn on the AFRM to denote service by Reserve Component personnel who volunteered or were called to active duty during a mobilization or a contingency designated by the Secretary of Defense.

CONCLUSIONS:

1. The applicant completed a normal tour of duty overseas in the Ryukyus Command from 13 May 1952 to 24 June 1953. He subsequently served on active duty from 12 February 1991 through 14 March 1991. Based on this service, the applicant is authorized award of the Overseas Service Ribbon and correction of his records to show this award.

2. The applicant’s records show that he completed one 10-year period of qualifying service (10 years of reserve service in which he earned 50 retirement points per year, all performed within 12 consecutive years). There is no evidence that he completed a second 10-year period of qualifying service. Therefore, he is entitled to award of the Armed Forces Reserve Medal with the Bronze Hourglass Device.

3. The applicant was also recalled from the Retired Reserve to active duty in support of Operation Desert Storm. As a result, he is also entitled to a “M” Device to be worn on his Armed Forces Reserve Medal with Bronze Hourglass Device.

4. Orders show the applicant was awarded the Excellence-in Competition Badge-Bronze-Pistol; therefore, he is entitled to correction of his records to show this badge.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the Overseas Service Ribbon, the Armed Forces Reserve Medal with Bronze Hourglass Device and with “M” Device, and the Excellence-in Competition Badge-Bronze-Pistol.
