         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that Block 8 of his DD Form 4/1 be changed to read 8 years instead of 6 years.

3. The applicant states that his initial enlistment was for 8 years not 6 years as shown on DD Form 4/1 (Enlistment/Reenlistment Document).

4. The applicant’s DD Form 4/1 shows, in Section B, Block 8, that he enlisted for a term of service of 6 years and 00 weeks. He contends, and other enlistment documents in his record support his contention that he should have been enlisted for 8 years and 00 weeks.

5. Army Regulation 601-210, Regular Army and Army Reserve Enlistment Program, paragraph 8-6, provides in pertinent part that the Commanding General (CG), US Total Army Personnel Command (PERSCOM), may determine that an error has been made in the term of enlistment shown on the DD Form 4-series. (For example, term of enlistment may be other than that intended by both the member and the Army. The DD Form 4-series will not be amended by “pen and ink” correction. Instead, a memorandum will be added to the member’s file giving the correct term.) The soldier will be assisted in preparing a DD Form 149, which will be attached to the documents cited above. The soldier’s application will be forwarded to the Army Board for Correction of Military Records for final action.

CONCLUSIONS:

1. The evidence of record establishes that the applicant was enlisted on 20 August 2001, for a term of service other than intended by both he and the Army. He believed that he was enlisting for a period of 8 years and 00 weeks but an error on the contract reflects he was enlisted for 6 years and 00 weeks.

2. Inasmuch as both the Army and the applicant agree that the term of service should be for 8 years and 00 weeks, it would be appropriate to correct the term of service reflected on the contract.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.










RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned enlisted on 20 August 2001 for a term of 8 years and 00 weeks.
