         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show two awards of the Army Achievement Medal.

3. The applicant states that his records and DD Form 214 show one award of the Army Achievement Medal. However, he contends that he has received two awards of the Army Achievement Medal. In support of his application, he submits a copy of his DD Form 214 and two award certificates for the Army Achievement Medal.

4. The applicant’s military records show that he enlisted in the Regular Army on 5 November 1986 for a period of four years. He successfully completed basic and advanced individual training and served in Germany from 26 August 1987 through 24 August 1989 as a track vehicle repairer. He reenlisted on 3 July 1990 for a period of three years and served in Southwest Asia from 28 August 1990 through 23 March 1991. The applicant was discharged from active duty on 10 October 1991.

5. The applicant's DD Form 214 shows one award of the Army Achievement Medal as an authorized award.

6. Item 9 (Awards, Decorations and Campaigns) on the applicant’s
DA Form 2-1 (Personnel Qualification Record) lists one award of the Army Achievement Medal.

7. The applicant’s personnel records contain Headquarters, 203rd Support Battalion Permanent Orders Number 2-11, dated 7 January 1989, which awarded him the Army Achievement Medal for meritorious achievement from 17 November 1988 through 2 December 1988.

8. The applicant provided a copy of an award certificate, dated 30 June 1989, which awarded him the Army Achievement Medal for meritorious service from 27 August 1987 through 23 August 1989. However, there are no orders available to the Board which show he was awarded a second award of the Army Achievement Medal.

9. A review of the applicant's personnel records revealed that he is entitled to award of the Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia and the Kuwait Liberation Medal awarded by the Government of Kuwait which are not shown on his discharge document.

10. Army Regulation 600-8-22 provides, in pertinent part, that the Army Achievement Medal is awarded to any member of the armed forces of the United States, who while serving in a noncombat area on or after 1 August 1981, distinguished themselves by meritorious service or achievement. The bronze oak leaf cluster is awarded to denote the second and succeeding awards of certain decorations, among which is the Army Achievement Medal.

11. The Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia (KLM-SA) was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991.

12. The Kuwait Liberation Medal awarded by the Government of Kuwait (KLM-K) was approved on 9 November 1995 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993.

CONCLUSIONS:

1. The applicant's DD Form 214 shows entitlement to one award of the Army Achievement Medal.

2. There are no orders available to the Board which authorize a second award of the Army Achievement Medal to the applicant. However, the applicant has provided an award certificate which is authenticated by the appropriate approving authority and shows he was awarded the Army Achievement Medal on 30 June 1989 for meritorious service from 27 August 1987 through 23 August 1989.

3. Upon review of the certificate submitted by the applicant, the Board has determined that this evidence is sufficient as a basis for a second award of the Army Achievement Medal. Therefore, the applicant is entitled to correction of his DD Form 214 to show two awards of the Army Achievement Medal.

4. Records show the applicant served in Southwest Asia from 28 August 1990 through 23 March 1991.

5. Based on the applicant's service in Southwest Asia, he is entitled to award of the Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia (KLM-SA) and the Kuwait Liberation Medal awarded by the Government of Kuwait (KLM-K) and correction of his records to show these awards.

6. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the Army Achievement Medal (First Oak Leaf Cluster), the Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia (KLM-SA) and the Kuwait Liberation Medal awarded by the Government of Kuwait (KLM-K).
