         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the Combat Infantryman Badge (CIB) be added to his DD Form 214 (Report of Transfer or Discharge).

3. The applicant states that he was awarded the CIB in Vietnam in the field but did not receive a certificate and it wasn’t added to his DD Form 214.

4. The applicant’s military records show that he was inducted on 20 December 1965, was trained as a light weapons infantryman and served in Vietnam with the 4th Battalion, 12th Infantry, 199th Infantry Brigade from 21 November 1966 to 30 September 1967. He was honorably released from active duty to the US Army Reserve on 2 October 1967.

5. Awards reflected on his DD Form 214 include the National Defense Service Medal, the Vietnam Service Medal, the Vietnam Campaign Medal, the Good Conduct Medal and the Purple Heart. The CIB is not shown as an authorized award.

6. The applicant’s records contain a copy of Headquarters 199th Infantry Brigade, Special Orders Number 11, dated 11 January 1967, awarding him the CIB

7. Department of the Army Pamphlet 672-3, Unit Citation and Campaign Participation Credit Register, shows that during his assignment to the 4th Battalion, 12th Infantry, 199th Infantry Brigade, the unit was awarded the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation.

8. Department of the Army General Order Number 8, dated 1974, awarded all personnel assigned to the United States Army Vietnam from 8 February 1962 through 28 March 1973, the Republic of Vietnam Gallantry Cross with Palm Unit Citation.

CONCLUSIONS:

1. Evidence of record shows that the applicant was awarded the CIB on 11 January 1967, and is therefore entitled to have it reflected on his DD Form 214.

2. Likewise, during his service in Vietnam with the 4th Battalion, 12th Infantry, 199th Infantry Brigade, the unit was awarded the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation and the Republic of Vietnam Gallantry Cross with Palm Unit Citation. Thus, he is entitled to have both of these awards shown on his DD Form 214.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.
RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by:

a. showing that the individual concerned was awarded the CIB, the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation and the Republic of Vietnam Gallantry Cross with Palm Unit Citation; and

         b. amending his DD Form 214 to reflect the above awards.
