         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show: that his last name is spelled XXXSON vice XXXSOM; that his place of birth is Winston County, Alabama, vice Mobile, Alabama; and that his correct social security account number (SSAN) is 422-XX-XXXX vice 224-XX-XXXX. He also requests that he be issued an honorable discharge certificate.

3. The applicant states that he was never issued an honorable discharge certificate. Therefore, he requests that he be issued an honorable discharge certificate and a corrected DD Form 214.

4. On 30 November 1960, at the time of enlistment in the Regular Army, the applicant indicated on all of his enlistment documents that his place of birth is Mobile, Alabama.

5. The applicant's SSAN is shown on his DA Form 24 (Service Record) as
224-XX-XXXX. The Service Record covers his military service from 10 November 1960-10 April 1964. However, his service number was most often used during his enlistment period.

6. The applicant served until he was honorably separated on 10 April 1964. Item 1 (Last Name) on the applicant's DD Form 214 shows that his last name is incorrectly spelled XXXSOM. Throughout his military record his last name is spelled XXXSON. Item 5 (Place of Birth) is listed as Mobile, Alabama. This is also listed as his place of birth on all of his enlistment paperwork. Item 32 (Remarks) lists his SSAN as 224-XX-XXXX.

7. The applicant's terminal date of reserve obligation ended on 26 August 1964. Therefore, he was authorized the issuance of an honorable discharge certificate as of this date. There is no evidence available to indicate that he was ever issued this certificate.

CONCLUSIONS:

1. For historical purposes, the Army has an interest in maintaining the accuracy of its records. The information contained in those records should reflect the names and facts that existed at the time the records were created.

2. At the time the applicant enlisted into the military, he spelled his last name as XXXSON and he performed all of his military duties under this name. Therefore, he is entitled to have his DD Form 214 corrected to show XXXSON.

3. All of the applicant's service records from enlistment through separation show his place of birth as Mobile, Alabama. His DD Form 214 is consistent with the service record in this regard and the Board presumes administrative regularity.
4. Likewise, the applicant's service records consistently reflect 224-XX-XXXX as his SSAN and the applicant has provided no information to refute this information.

5. The applicant is authorized the issuance of an honorable discharge certificate as of 26 August 1964.

6. In view of the foregoing, the applicant’s records should be corrected, but only as recommended below.

RECOMMENDATION
:

1. That all of the Department of the Army records related to this case be corrected:

a. by issuing the individual concerned a DD Form 215 (Correction to DD Form 214) to show that his last name is spelled XXXSON; and

         b. by issuing the individual an honorable discharge certificate.

2. That so much of the application as is in excess of the foregoing be denied.
