APPLICANT REQUESTS: That he be awarded the Army Service Ribbon (ASR).
APPLICANT STATES: That the award was implemented after his separation date. He contends that the ASR was awarded to personnel prior to establishment and retroactively.
EVIDENCE OF RECORD: The applicant's military records show:
The applicant enlisted in the Regular Army on 29 January 1980. His DA Form
2-1 (Personnel Qualification Record) item 35 (Record of Assignments) shows he completed basic combat training. He was assigned to the 2nd Battalion, Academy of Health Sciences, Fort Sam Houston, TX for advanced individual training (AIT).
Upon completion of AIT the applicant was awarded military occupational specialty 91B10 (medical specialist) based on Orders 86-34, dated 1 May 1980, from Headquarters Fort Sam Houston, TX.
On 6 February 1981, the applicant was administratively discharged with an honorable characterization of service. He completed 1 year and 6 days of creditable active service.
Army Regulation 600-8-22 prescribes Army policy and criteria concerning individual military awards. The ASR was established on 10 April 1981 and is awarded to members of the U. S. Army for successful completion of initial entry training. Effective 1 August 1981, all members of the Active Army, Army National Guard, and USAR in an active Reserve status are eligible for this award. The ribbon may be awarded retroactively to those personnel who completed the required training before 1 August 1981 provided they had an Active Army status on or after 1 August 1981.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
2. The available evidence of record shows the applicant did not meet the eligibility requirement for award of the ASR in that he was discharged prior to the establishment of the award and he did not have an Active Army status on or after 1 August 1981.
3. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
