         The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

APPLICANT REQUESTS: That her Certificate of Release or Discharge from Active Duty, DD Form 214, be amended to show she was released from active duty on 19 May 1988.

APPLICANT STATES: That on the evening before she was to be separated she was in an accident and spent two weeks in the hospital. She needs the correction for a disability claim. She provides no supporting evidence.

EVIDENCE OF RECORD: The applicant's military records show:

She enlisted in the U. S. Army Reserve on 10 April 1987. She was ordered to initial active duty for training (IADT) on 29 October 1987. Her DD Form 214 shows she was released from IADT on 11 May 1988 after completing basic training and advanced individual training.

Records at the Defense Finance and Accounting Service – Indianapolis Center show the applicant’s last date of IADT as 11 May 1988.

Army Regulation 601-210, Initial Entry/Prior Service Trainee Support, paragraph 3-31c(3) states that a complete line of duty investigation will be completed on all members of the Army National Guard of the United States and U. S. Army Reserve who are injured or become ill or otherwise require medical care during IADT.

Army Regulation 135-200, Active Duty for Training, Annual Training, and Active Duty for Special Work of Individual Soldiers, paragraph 2-7c states that extensions to complete line of duty determinations, for continuation of hospitalization, medical care, physical disability processing, or continuation of pay and allowances will be per guidance of Headquarters, Department of the Army.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1. It appears that, if the applicant was injured while still on IADT, she should have been extended on active duty at least to complete a line of duty determination and for the duration of her hospitalization. However, the applicant provides only her statement as evidence that she was injured. This is insufficient information on which the Board can base a decision.

2. If the applicant can provide medical records showing the date and nature of the injury, the length of hospitalization and date of discharge from the hospital, and a line of duty determination, she may apply for reconsideration.

3. In view of the foregoing, there is no basis for granting the applicant's request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
