         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected by showing that he was awarded the Army Commendation Medal and authorized one bronze service star for wear on the Kosovo Campaign Medal.

3. The applicant submits a copy of the DA Form 638 (Recommendation for Award) and the award certificate for the Army Commendation Medal. He also submits a copy of the Joint Staff message announcing the establishment of the Kosovo Campaign Medal.

4. The applicant’s military records show that he served on active duty for 4 years and was separated with an honorable characterization of service on 30 December 2001, and transferred to the Army Reserve Control Group (Reinforcement) as a sergeant (E-5). His DD Form 214 lists the Kosovo Campaign Medal as an authorized award and item 18 (Remarks) notes that he served in Kosovo from 27 August 1999 to 12 November 1999.

5. The DA Form 638 shows that the award of the Army Commendation Medal was approved and the award was announced in Permanent Orders Number 325-11. The award certificate confirms the orders number and was signed on 25 November 2001.

6. Joint Staff message R 121501Z May 2000 announced the establishment of the Kosovo Campaign Medal and provided for two campaign periods, the Kosovo Air Campaign (24 March through 10 June 1999) and the Kosovo Defense Campaign (11 June 1999 through a date to be determined). The criteria specified that each individual who was authorized the medal was qualified for at least one bronze service star.

CONCLUSIONS:

1. The applicant was awarded the Army Commendation Medal. He was also awarded the Kosovo Campaign Medal and is qualified for one bronze service star for wear thereon. The awards should be shown on his DD Form 214.

2. In view of the foregoing findings and conclusions, correcting the applicant’s records as recommended below would correct an error.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by amending the DD Form 214 of the individual concerned to show that he was awarded the Army Commendation Medal and the Kosovo Campaign Medal with one bronze service star.
