         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 be corrected to show his foreign service in Saudi Arabia, and to reflect his authorized awards.

3. The applicant provides a copy of reassignment orders, a request for a passport for Kuwait, and a copy of orders showing award of the Armed Forces Expeditionary Medal.

4. The applicant’s military records show that he enlisted in the Army for four years on 17 January 1997, completed training and in May 1997 was assigned to Fort Leonard Wood, Missouri.

5. On 16 July 1998 the applicant was assigned to Headquarters, U.S. Army Forces Central Command in support of ARCENT-FWD operations for a period not to exceed 179 days, with a reporting date of 27 July 1998. The order directing his assignment indicated that it was not a permanent change of station, and that variations in his itinerary was authorized, to include Egypt, Kuwait, Qatar, and Bahrain. Country clearance to Saudi Arabia was requested by the Army Engineer Center.

6. The applicant was promoted to pay grade E-4 on 1 August 1998. On 3 December 1998 he was awarded the Army Commendation Medal for the period 28 July 1998 to 12 January 1999. The award certificate states in part, “His tireless efforts reflect great credit upon himself, the United States Army Forces Central Command – Saudi Arabia, and the United States Army.” The order authorizing the award was issued by HQ US ARCENT-SA, Riyadh, Saudi Arabia.

7. A 5 February 2000 memorandum from Headquarters, Task Force Owen, awarded the Armed Forces Expeditionary Medal to the applicant for his participation in Operation Desert Spring in the expanded area of eligibility of Southwest Asia Iraq Operations. That memorandum indicated that the applicant engaged in Operation Desert Spring for at least 30 consecutive days in Kuwait from 15 December 1999 to 20 April 2000.

8. The applicant was released from active duty on 16 January 2001. His DD Form 214 does not reflect his foreign service or award of the Armed Forces Expeditionary Medal.

9. Army Regulation 635-5 provides instructions for completion of the DD Form 214 and states, in pertinent part, that the total amount of foreign service completed during the applicant’s period of service will be obtained from the applicant’s enlisted record brief (ERB) and will be entered in block 12c of that form.


CONCLUSIONS:

1. The applicant was awarded the Armed Forces Expeditionary Medal. That award should be reflected on his DD Form 214.

2. The applicant’s ERB is not available. Nonetheless, the evidence suggests that he served in Southwest Asia for 5 months and 14 days from 28 July 1998 to 12 January 1999, as evidenced by the certificate showing award of the Army Commendation Medal for that period of time; and that he served at least 30 days in Kuwait during the period 15 December 1999 to 20 April 2000. Consequently, it would be appropriate to correct the applicant’s DD Form 214 to show that the applicant had 6 months and 14 days of foreign service.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Armed Forces Expeditionary Medal, and that he had 6 months and 14 days of foreign service.
