         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Report of Transfer or Discharge (DD Form 214) be corrected to show that he was awarded the Vietnam Campaign Medal, a silver service star, the Vietnam Gallantry Cross with Palm Unit Citation and the Bronze Star Medal (BSM).

3. The applicant states, in effect, that he was furnished the awards and they should be included on his DD Form 214.

4. The applicant’s military records show that after he completed 2 years, 10 months, and 19 days of total active service he enlisted in the Army on 22 April 1966, for 3 years in the pay grade of E-2. He successfully completed his training as a pioneer and on 2 November 1967, he was transferred to Vietnam.

5. His awards include the Purple Heart, the National Defense Service Medal, the Army Commendation Medal with “V” Device, the Vietnam Service Medal, the Combat Infantryman Badge, the Parachutist Badge and the Good Conduct Medal (2nd Award).

6. A review of the records show that General Orders Number 7937 were published on 22 October 1968, awarding the applicant the BSM for distinguishing himself by outstanding meritorious service in connection with ground operations against a hostile force in the Republic of Vietnam during the period from 1 January 1968 to 31 August 1968.

7. He returned to the Continental United States on 11 November 1968 and he was honorably discharged 21 April 1969. The DD Form 214 that he was furnished at the time of his discharge fails to show that he was ever awarded the BSM.

8. On 22 July 1996, the United States Army Reserve Personnel Center (ARPERCEN) notified the applicant that a review of his records concluded that he was authorized the Republic of Vietnam Campaign Medal, one silver service star on his already awarded Vietnam Service Medal in lieu of five bronze service stars for taking part in five campaigns in Vietnam and the Republic of Vietnam Gallantry Cross with Palm Unit Citation. However, his records were never corrected to reflect his entitlement to the awards.

CONCLUSIONS:

1. An error was made during the preparation of the applicant’s DD Form 214, which resulted in the omission of the BSM. The evidence of record shows that orders were published on 22 October 1968 awarding him the BSM and his DD Form 214 should be corrected accordingly.

2. Additionally on 22 July 1996, the ARPERCEN notified the applicant that he was authorized the Republic of Vietnam Campaign Medal, one silver service star on his already awarded Vietnam Service Medal instead of five bronze service stars for taking part in five campaigns in Vietnam and the Republic of Vietnam Gallantry Cross with Palm Unit Citation.

3. Through no fault of his own, the awards were never included on his DD Form 214 and it would now be appropriate to amend his record to reflect his awards.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by amending the DD Form 214 of the individual concerned to show that he was awarded the BSM, the Republic of Vietnam Campaign Medal, one silver service star in lieu of five bronze service stars on his already awarded Vietnam Service Medal and the Republic of Vietnam Gallantry Cross with Palm Unit Citation.
