2. The applicant requests that his DD Form 214 (Report of Transfer or Discharge) be changed to show that he received the Bronze Star Medal (BSM), three awards of the Purple Heart Medal; and that his social security number (SSN), service number (SN), and home of record (HOR) on that form be corrected (NOTE: His SSN, SN, and HOR have been administratively corrected).
3. The applicant entered the Army in May 1967. In
June 1967 he was awarded the Expert Qualification Badge with rifle bar. He completed training as a medical corpsman, and in November was assigned to an infantry battalion in Vietnam.
4. On 20 January 1968 he received a fragmentation wound to his upper chest and was awarded the Purple Heart. That award is shown on his DD Form 214. In February 1968 he was awarded the Combat Medical Badge, and on 27 July 1968 he was awarded the Bronze Star Medal with V Device for his actions on 11 February. In December 1968 he was awarded the Army Commendation Medal. That award is shown on his
DD Form 214. The organization he was with during his time in Vietnam was awarded the Valorous Unit Award, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation. He participated in five campaigns during his tour in Vietnam.
5. The applicant returned to the United States and was released from active duty at Oakland, California on
19 December 1968. His DD Form 214 does not show award of the Expert Qualification Badge with rifle bar, the Combat Medical Badge, or the BSM V Device (His DD Form 214 was administratively corrected to show award of the BSM, but without the V device). This form does not show any unit awards, nor campaign and service medals for his duty in Vietnam.
6. Army Regulation 600-8-22 provides that the Purple Heart is awarded for a wound sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment, and the medical treatment must have been made a matter of official record.
7. The aforementioned regulation provides for award of the Vietnam Service Medal (VSM) and states, in pertinent part, that the VSM is awarded to all members of the Armed Forces serving in Vietnam from 3 July 1965 through 28 March 1973. One bronze service star is authorized for each campaign.
A silver star is worn instead of five bronze service stars.
8. Army Regulation 600-8-22 provides for the award of the Republic of Vietnam Campaign Medal and states, in pertinent part, that the medal will be awarded to personnel who have served in Vietnam for six months during the period from
1 March 1961 to 28 March 1973.
CONCLUSIONS:
1. There is no record of the applicant having been wounded more than once. He is not entitled to any additional awards of the Purple Heart Medal.
2. The applicant is entitled to award of the Bronze Star Medal with V device, the Expert Qualification Badge with rifle bar, the Combat Medical Badge, the Valorous Unit Award, the Vietnam Service Medal with one silver service star, the Republic of Vietnam Campaign Medal, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation.
3. All of the applicants authorized awards should be shown on his DD Form 214.
4. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicants records as recommended below.
RECOMMENDATION:
1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Bronze Star Medal with V device, the Expert Qualification Badge with rifle bar, the Combat Medical Badge, the Valorous Unit Award, the Vietnam Service Medal with one silver service star, the Republic of Vietnam Campaign Medal, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation.
2. That so much of the application as in excess of the foregoing be denied.
