         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his enlistment contract be corrected to show he enlisted in pay grade E-1.

3. The applicant states, in effect, that he was approved to enlist in pay grade E-1, not pay grade E-3.

4. On 5 September 2001, the U. S. Total Army Personnel Command made a grade determination approving the applicant’s enlistment in the Regular Army in pay grade E-1. His enlistment contract, DD Form 4/1, erroneously shows that he enlisted in the Regular Army on 31 October 2001 in pay grade E-3. On 1 November 2001, he waived his enlistment commitment of pay grade E-3 and accepted pay grade E-1.

CONCLUSIONS:

1. There is an administrative error on the applicant’s DD Form 4/1. The evidence of record shows he was approved to enlist in the Regular Army in pay grade E-1, not pay grade E-3.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 4/1 dated 31 October 2001 be corrected to show he enlisted in pay grade E-1.
