         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to reflect his award of the Meritorious Service Medal (MSM).

3. The applicant states, in effect, that he received the MSM after his retirement and desires it to be entered in his records.

4. The applicant’s military records show that he was honorably released from active duty on 31 May 2001 and was placed on the Retired List in the pay grade of E-6 on 1 June 2001. His report of separation (DD Form 214) listed his highest award as the Army Commendation Medal. However, on 11 April 2001, Permanent Orders Number 43-11 was published which awarded the applicant the MSM for the period of 10 June 1990 to 31 May 2001. There is no indication in the available records to show when the applicant received the award. However, it was omitted from his DD Form 214.

CONCLUSIONS:

1. The evidence presented in his case shows that he was awarded a MSM; however, it appears that an administrative oversight resulted in the award not being entered in his records prior to his REFRAD. Accordingly, the Board finds that it would be in the interest of justice to do so at this time.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the MSM.
