         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to reflect three awards of the Army Achievement Medal (AAM), an award of the Drivers Badge and award of the Additional Skill Identifier (ASI) V9.

3. The applicant states, in effect, that he was awarded three awards of the AAM, the Drivers Badge and the ASI of V9, that were not included on his report of separation (DD Form 214) at the time of his release from active duty (REFRAD). In support of his application he submits certificates and orders for his awards.

4. The applicant’s military records show that he enlisted on 2 March 1989, for a period of 3 years. He completed his training and was advanced to the pay grade of E-4 on 1 May 1991. He continued to serve until he was honorably REFRAD on 2 March 1992 and was transferred to the United States Army Reserve (USAR) Control Group (Reinforcement). He was honorably discharged from the USAR on 4 March 1997. At the time of his REFRAD, his DD Form 214 indicates that he was serving in the military occupational specialty (MOS) of 31C1O00 and was awarded the National Defense Service Medal, the Army Lapel Button, the Army Service Ribbon, and the Good Conduct Medal.

5. The documents submitted by the applicant show that orders were published on 10 January 1991, which awarded him the Drivers Badge. He also submits copies of Certificates and orders for three awards of the AAM. However, two awards of the AAM have the same order number and all of the awards have overlapping period of service. There is no indication that he was ever awarded the ASI of V9 or that he was qualified for such an award.

6. Army Regulation 600-8-22 provides the policies and procedures for awards and decorations. It provides, in pertinent part, that only one decoration may be awarded to an individual for the same act, achievement, or period of meritorious service. Each award of the AAM must be awarded on a permanent order.

7. Army Regulation 611-201 governs the award of the ASI. It provides, in pertinent part, that award of the ASI of V9 is announced in orders and for personnel serving in the MOS of 31C, soldiers must meet the prerequisites of participation in the Personnel Reliability Program under Army Regulation 50-5, chapter 3. The ASI of V9 identifies personnel serving duties as Communications Operation and Maintenance (Theater Forces Communications System Terminal).

CONCLUSIONS:

1. The applicant clearly was awarded the Drivers Badge on 10 January 1991 and an administrative error resulted in that badge being omitted from his DD Form 214. Accordingly, it would be in the interest of justice to add this award at this time.

2. While the Board agrees that the applicant was awarded the AAM, it appears that he was only awarded two awards of the AAM because two of the awards he has presented have the same order number. Inasmuch as an individual cannot receive two awards for the same act or period, the Board finds that he should only receive credit for two awards of the AAM in the form of the AAM 1st Oak Leaf Cluster.

3. Inasmuch as there is no evidence to show that he met the criteria or was awarded the ASI of V9, the Board finds that there is no basis to award it to him at this time.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Drivers Badge and the AAM 1st Oak Leaf Cluster.

2. That so much of the application as is in excess of the foregoing be denied.
