         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his separation document (DD Form 214) be corrected to show the Army Achievement Medal (AAM) (2nd Oak Leaf Cluster).

3. The applicant states, in effect that his DD Form 214 does not include the AAM (2nd Oak Leaf Cluster) he received in the list of authorized awards. In support of his application, he submits three AAM award certificates and a copy of his DD Form 214.

4. The applicant’s military records show that he entered the Army on
11 October 1984. He was trained in, awarded, and served in MOS 64C (Motor Transport Operator). He continuously served on active duty for 3 years until being honorably released from active duty (REFRAD) on 10 October 1987, by reason of expiration term of service.

5. The separation document (DD Form 214) issued to the applicant on the date of his separation confirms that he held the rank and pay grade of specialist four/E-4 (SP4/E-4) at that time. It also shows that he earned the following awards during his tenure on active duty: Army Good Conduct Medal; Expert Qualification Badge with hand grenade bar; Sharpshooters Qualification Badge with rifle bar; Army Service Ribbon; and Drivers Badge. The applicant’s DD Form 214 does not list the AAM (2nd Oak Leaf Cluster) as an authorized award.

6. The applicant’s Enlisted Qualification Record (DA Form 20) confirms that he was assigned to Fort Drum, New York from 9 March 1985 to 10 October 1987, and that he was assigned to 10th Supply & Transportation Battalion, 10th Infantry Division performing duties in MOS 64C.

7. The applicant provided a copy of three AAM award certificates that shows that he was awarded the AAM for meritorious achievement for the following three occasions: from 27 May 1986 to 31 May 1986, while assigned to Company D, 10th Supply & Transportation Battalion, 10th Infantry as a truck driver; from 20 March 1985 to 10 October 1987, while assigned to Company D, 10th Supply
& Transportation Battalion, 10th Infantry as a motor transport operator; and from
8 June 1987 to 29 June 1987, for exceeding the normal requirements as a driver while attached to the 27th Infantry Brigade.

CONCLUSIONS:

1. The Board notes the applicant’s contention that the AAM (2nd Oak Leaf Cluster) should be added to the list of awards contained in his DD Form 214, and it finds this claim has merit.


2. The applicant provides three AAM award certificates that shows he was awarded the AAM for meritorious achievement for the following three periods of service: 27 May 1986 to 31 May 1986; 20 March 1985 to 10 October 1987; and
8 June 1987 to 29 June 1987. These periods are consistent with the applicant’s unit assignment history and the Board finds no reason to doubt their validity. Therefore, the Board finds it would be appropriate to add the AAM (2nd Oak Leaf Cluster) to his record at this time.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case for the individual concerned be corrected by showing he earned the Army Achievement Medal (2nd Oak Leaf Cluster) and by providing him a corrected separation document that includes this award.
