APPLICANT REQUESTS: That he be awarded the Purple Heart (PH).
APPLICANT STATES: He was blown out of a truck in Korea. He was treated for lacerations to his face. He has established service connection for those lacerations.
In support of his application he submits a treatment record which shows that he had lacerations to his face sutured on 31 October 1952.
EVIDENCE OF RECORD: The applicant's military records could not be located and are presumed to have been destroyed in the fire at the record repository in 1973. The following information was derived from the applicant’s separation document which he, himself, provided.
He was inducted on active duty on 30 July 1951 and was promoted to pay grade E-5. He was honorably released from active duty on 25 April 1953. His awards include the Korean Service Medal with two bronze service stars, and the United Nations Service Medal. Item 29 of his separation document, “Wounds received as a result of action with enemy forces,” is blank.
Army Regulation 600-8-22 provides, in pertinent part, that the Purple Heart is awarded for wounds sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.
As a matter of information, on the occasion of the 50th anniversary of the Korean War, the Government of the Republic of Korea issued the Korean War Service Medal to pay tribute to eligible Korean War veterans for their historic endeavors to preserve the freedom of the Republic of Korea and the free world. On 20 August 1999, the Department of Defense approved acceptance and wear of this foreign award. The Department of Defense has assigned responsibility to the Department of the Air Force for distribution of the Korean War Service Medal to eligible veterans of all services. To apply, veterans must provide a copy of their discharge paper to the Awards and Decorations Section, Headquarter, Air Force Personnel Center, 550 C Street West, Suite 12, Randolph Air Force Base, Texas 78150-4714. Once the Korean War Service Medal has been authorized by the Department of the Air Force, the applicant may apply to the Army Board for Correction of Military Records to add this foreign award to his DD Form 214.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record and applicable law and regulations, it is concluded:
1. While the applicant has shown that he sustained lacerations to his face for which he received sutures, he has not provided any evidence to show how he sustained those lacerations.
2. Without evidence to show that the applicant’s facial lacerations were the result of hostile action, the applicant is not entitled to the PH.
3. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
