The applicant and counsel, if any, did not appear before the Board.

The Board considered the following additional evidence:

Exhibit-Memorandum for Record on discovery of orders for the     applicant’s Bronze Star Medal, dated 26 September 2001.

THE BOARD ADDITIONALLY FINDS:

14. On 26 September 2001, the Awards Branch of the U.S. Total Army Personnel Command reported the applicant had been awarded the Bronze Star Medal for meritorious service in Vietnam by Americal Division General Orders Number 13858, dated 16 October 1970.

THE BOARD ADDITIONALLY CONCLUDES:

7. At the time of the Board’s 21 August 2001 decision in this case, it was the intent of the Board to make the applicant’s record as administratively correct as it should properly have been at the time of his separation from active duty.

8. In view of the additional factors in this case the applicant is entitled to correction of his record to show he was awarded the Bronze Star Medal for meritorious service based on Americal Division General Orders Number 13858, dated 16 October 1970.

9. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.

THE BOARD RECOMMENDS:

3. That all of the Department of the Army records related to this case be corrected by amending the Board’s recommendation at paragraph 2 appearing in the proceedings, dated 21 August 2001, to show that the individual concerned was awarded the Bronze Star Medal.

There are no orders in the applicant's military service records awarding him the Purple Heart. The date for which the medal was awarded is within the applicant's period of service in Vietnam. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 with an effective date of 12 March 1971 to show award of the Purple Heart for wounds received on 11 July 1970 in the Republic of Vietnam, the Army Commendation...

The applicant requests that his DD Form 214 (Report of Transfer or Discharge) be corrected to show that he was awarded the Purple Heart. The applicant's OMPF (Official Military Personnel File) shows that he was awarded the Army Commendation Medal for meritorious achievement for the period 1 August 1970 to 30 November 1970; however, his record does not reflect a second award of that medal, nor a recommendation for that award. The applicant states that he did not realize that the Purple Heart was not on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).
