         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the award of the Bronze Star Medal (BSM) be reflected on his DD Form 214.

3. The applicant states that the award of the BSM is not shown on his DD Form 214 because it was awarded after his discharge.

4. The applicant’s military records show that he entered on active duty on 15 February 1952. The applicant was an infantryman who had 1 year, 5 months, and 28 days of foreign service. He served with Company I of the 279th Infantry Regiment, a 45th Infantry Division organization, during the Korean War, and was awarded the National Defense Service Medal, the Korean Service Medal with three bronze service stars, the United Nations Service Medal, and the Combat Infantryman Badge. He was released from active duty in the rank of Corporal with an honorable characterization of service on 14 November 1953. He had 1 year and 9 months of service.

5. The applicant submits a copy of a certificate showing that he was awarded the Bronze Star Medal for meritorious achievement for the period 3 November 1952 to 27 July 1953; and a copy of a citation showing that he was awarded the BSM for meritorious service for that same period.

6. DA Pamphlet 672-1, the Unit Citation and Campaign Participation Credit Register, shows that the 279th Infantry Regiment was awarded the Republic of Korea Presidential Unit Citation for its actions during the time the applicant was assigned to that organization.

7. Army Regulation 600-8-22 prescribes the eligibility criteria for award of the Army Good Conduct Medal, and states in pertinent part, that the medal is awarded for exemplary behavior, efficiency, and fidelity in active Federal military service. One of the qualifying periods of service for the award is upon termination of service on or after 27 June 1950, of less than 3 years but more than 1 year (for first award only).

CONCLUSIONS:

1. The applicant’s documents showing award of the BSM after his separation appear accurate, and the Board believes it so. That award was more than likely for meritorious service, not achievement, as shown on the award certificate. Nevertheless, his record should reflect award of the BSM.

2. The applicant served with the 279th Infantry Regiment during the period when it was awarded the Republic of Korea Presidential Unit Citation. The applicant is entitled to that award.

3. The applicant served his country honorably and faithfully as evidenced by his DD Form 214. He is entitled to award of the Army Good Conduct Medal.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Bronze Star Medal, the Republic of Korea Presidential Unit Citation, and the Army Good Conduct Medal.
