APPLICANT REQUESTS: That his records be corrected to show entitlement to award of the Army Commendation Medal (ARCOM) and that his place of entry into the Army be changed.
APPLICANT STATES: That he was awarded the ARCOM but it was erroneously left off his records. He indicates he entered the Army from Fairmont, West Virginia.
EVIDENCE OF RECORD: The applicant's available military records show:
During the period 2 February through 27 June 1973, the applicant served in the Army Reserve Delayed Enlistment Program.
On 28 June 1973, after being processed at the Armed Forces Entrance and Examining Station (AFEES), Fairmont, West Virginia, he entered active duty at the Recruiting Main Station (RMS), Beckley, West Virginia. He completed his required training and was awarded military occupational specialty 16E (Hawk Fire Crewman). He was promoted to pay grade E-6, effective 1 October 1981.
On 20 November 1985, he was placed on the Temporary Disability Retired List. His separation document indicates he had 12 years, 4 months and 23 days of creditable service.
Army Regulation 600-8-22 provides that the Army Commendation Medal may be awarded to any member of the Armed Forces of the United States who, while serving in any capacity with the Army after 6 December 1941, distinguished himself or herself by heroism, meritorious achievement or meritorious service. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. There is no evidence in the available records that the applicant was recommended for or awarded the ARCOM; therefore, he is not entitled to that award.
2. The evidence shows the applicant was processed for active duty in the AFEES, Fairmont, WV and enlisted onto active duty at the RMS, Beckley, WV.
3. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
4. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
