         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the Purple Heart be added to his Report of Separation, DD Form 214.

3. The applicant states that his DD Form 214 shows that he was wounded in the neck on 15 February 1951.

4. The applicant’s military records were lost or destroyed in the National Personnel Records Center fire in 1973. Information contained herein was obtained from alternate sources.

5. The applicant entered the Army on 20 August 1947. He served 2 years, 7 months, and 24 days of foreign service. He was separated on 28 July 1951 in the rank of corporal after completing 3 years, 11 months, and 13 days of creditable active service with no lost time. His DD Form 214, item 29 shows that he was wounded in the left side of the neck in Korea on 15 February 1951. Item 27 shows he was awarded the Occupation Medal – Japan, the Combat Infantryman Badge, and the Korean Service Medal with bronze service star.

6. On 12 December 2000, an Authorization for Issuance of Awards, DA Form 1577, authorized issuance of the Purple Heart, the Army Good Conduct Medal, the National Defense Service Medal, and the United Nations Service Medal in addition to the awards listed on his DD Form 214 to the applicant.

7. Army Regulation 600-8-22 provides policy and criteria concerning individual military decorations. In pertinent part, it states that the Purple Heart is awarded to any member of an Armed Force who has been wounded or killed in any action against an enemy of the United States. The wound must have required treatment by a medical officer and records of medical treatment for wounds or injuries received in action must have been made a matter of official record.

CONCLUSIONS:

1. The applicant’s DD Form 214, item 29 shows that the applicant had been wounded in action. The Board presumes that his wound was treated by medical personnel and was made a matter of official record or else it would not have been noted on his DD Form 214. Therefore, his DD Form 214 should be amended to add the Purple Heart and also the Army Good Conduct Medal, the National Defense Service Medal, and the United Nations Service Medal.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That the applicant’s DD Form 214 be amended to add the Purple Heart, the Army Good Conduct Medal, the National Defense Service Medal, and the United Nations Service Medal.
