         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Report of Separation from the Armed Forces of the United States) be corrected to reflect that he was awarded the Purple Heart. He states, in effect, that he has the medal but it is not recorded on his separation document.

3. Records available to the Board indicate the applicant returned to active duty on 5 March 1948 and served nearly 13 months overseas where he was awarded the Korean Service Medal.

4. According to a telegram, included with his application, he was “slightly wounded in action in Korea on 8 April 51.” On 14 March 1952 he was discharged. Item 29 (wounds received as a result of action with enemy forces) on his DD Form 214 confirms the 8 April 1951 wound. The report does not, however, reflect entitlement to the Purple Heart.

CONCLUSIONS:

1. Evidence available to the Board confirms the applicant was wounded as a result of hostile action on 8 April 1951 and as such is entitled to an award of the Purple Heart. His records should be corrected accordingly.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by awarding the individual concerned the Purple Heart for wounds sustained on
8 April 1951.
