         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show an unspecified unit citation and other awards to which he is entitled.

3. The applicant states that he believes that he received a unit citation and other medals that a lieutenant recommended him for and that his DD Form 214 should show these medals. He also states that he was a sergeant in Vietnam and he killed many enemy soldiers. He contends that he should have received a unit citation like others in his unit, 5th Battalion, 60th Infantry (Mechanized), 9th Infantry Division.

4. The applicant’s military records show that he enlisted in the Regular Army on 25 July 1966 for a period of three years. He completed infantry training and served in Vietnam from 25 October 1967 through 16 October 1968. The applicant was honorably released from active duty on 24 July 1969.

5. The applicant’s DD Form 214 does not list any unit citations as authorized awards.

6. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the unit awards received by units serving in Vietnam. This document shows the unit, to which the applicant was assigned, was cited for award of the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation based on Department of the Army General Orders Number 59, dated 1969.

7. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) also shows the applicant is entitled to award of the Valorous Unit Award and the Republic of Vietnam Gallantry Cross with Palm Unit Citation based on Department of the Army General Orders Number 43, dated 1970.

8. The applicant’s DD Form 214 shows the Vietnam Service Medal as an authorized award. His DA Form 20 (Enlisted Qualification Record) shows he received credit for participation in the Vietnam Counteroffensive, Phase III Campaign in item 39 (Campaign). Army Regulation 600-8-22, Table B-1, shows he was also entitled to credit for participation in the Tet Counteroffensive Campaign, the Vietnam Counteroffensive, Phase IV Campaign, and the Vietnam Counteroffensive, Phase V Campaign during his tour in Vietnam.

9. Army Regulation 600-8-22, in pertinent part, authorizes award of a bronze service star, based on qualifying service, for each campaign listed in Appendix B of this regulation and states that authorized bronze service stars will be worn on the appropriate service medal.

CONCLUSIONS:

1. Evidence of record shows the applicant’s unit in Vietnam was cited for award of the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, the Valorous Unit Award and the Republic of Vietnam Gallantry Cross with Palm Unit Citation; therefore, his DD Form 214 will be amended to show these awards.

2. The applicant’s DD Form 214 shows the Vietnam Service Medal as an authorized award. However, evidence of record shows the applicant participated in four campaigns during his assignment in Vietnam which are not correctly shown by award of four bronze service stars for wear on his Vietnam Service Medal. Therefore, in accordance with the governing regulation, the applicant is entitled to the Vietnam Service Medal with four bronze service stars and correction of his DD Form 214 to show these awards.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to the individual concerned be corrected:

a. by deleting the Vietnam Service Medal from item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214; and

b. by showing he was awarded the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, the Valorous Unit Award, the Republic of Vietnam Gallantry Cross with Palm Unit Citation and the Vietnam Service Medal with four bronze service stars.
