         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to reflect award of the Purple Heart. He states he never received the award.


3. Records indicate he served on active duty between April 1963 and April 1968. In August 1967 he was assigned to Vietnam and on 20 November 1967 he was awarded the Purple Heart for wounds sustained on 19 November 1967. Orders, issued by the 71
st Evacuation Hospital, confirmed the award. The award, however, was not reflected on his 1968 DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).

4. On 10 February 1968 he sustained fragment wounds to his right arm and right side as the result of a hostile mortar attack. A Western Union Telegram indicates the applicant was treated and returned to duty. There is no indication that he was ever awarded a Purple Heart for this incident.

CONCLUSIONS:

1. The evidence confirms the applicant was wounded on two separate occasions while in Vietnam. His records should be corrected accordingly.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected:

a. by showing that he was awarded a Purple Heart for wounds sustained on 19 November 1967; and

b. by awarding him a Purple Heart for wounds sustained on 10 February 1968.
