APPLICANT REQUESTS: That his records be corrected to show he changed his name. He states that he served as S___ P___ but legally changed his name to M___ S___ P___ in 1966.
EVIDENCE OF RECORD: The applicant's military records show:
He was inducted into the Army on 18 April 1946 under the name S___ P___. He served under that name and was separated on 16 May 1947 under the name S___ P___.
In March 1960, the applicant legally changed his name to M___ S___ H___. In September 1966, he legally changed it to M___ S___ P___.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. For historical purposes, the Army has an interest in maintaining the accuracy of its records. The data and information contained in those records should actually reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, this Board is reluctant to recommend that those records be changed.
2. The applicant appropriately served on and was released from active duty under the name he provided upon his entry onto active duty. He did not legally change his name until 1960 and 1966, years after his separation.
3. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
