         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Enlistment/Reenlistment Document Armed Forces of the United States, DD Form 4/1, be corrected to show he enlisted in pay grade E-4. He makes no additional statement.

3. The applicant’s military records are not available. Information contained herein was obtained from alternate sources.

4. The applicant apparently enlisted in the U. S. Army Reserve around February 1997. He was promoted to specialist, E-4 on 2 August 1998. He requested a conditional waiver to enlist in the Regular Army on 20 October 2000. He enlisted in the Regular Army on 22 May 2001 in pay grade E-3.

5. Army Regulation 601-210 prescribes eligibility criteria governing the enlistment of persons, with or without prior service, into the Regular Army and the U.S. Army Reserve. In pertinent paragraph, it states that when an applicant was last separated from any Component or is a current member of a Reserve Component in the grade of E-4 with not more than 5 years Active Federal Service and enlists within 24 months from the date of separation, the enlistment grade will be Specialist, E-4.

CONCLUSIONS:

1. The evidence of record shows that the applicant was eligible to enlist in the Regular Army on 22 May 2001 in pay grade E-4.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 4/3 dated 22 May 2001 be corrected to show he enlisted in pay grade E-4 and that he be paid any and all pay and allowances due as a result of this correction.
